What the Marketing Permission To Advertise Does

A Marketing Permission To Advertise is a written consent that authorizes a person or organization to use an individual’s name, likeness, testimonial, or other identifying information for advertising and promotional purposes. It sets the permitted uses (print, digital, social media, video), the duration of consent, geographic scope, and any limitations or required credits. For consumer-facing agreements, the form should also document how the signer can withdraw consent and whether any compensation applies. Electronic execution is generally permitted under ESIGN and UETA when intent and consent are clearly recorded.

Why a Clear Permission Form Matters

A concise permission form reduces legal risk, clarifies permitted uses, and documents consent for marketing activities. Preserving intent and retention supports enforceability under ESIGN and state e-signature laws while making campaign approvals auditable.

Why a Clear Permission Form Matters

Who Typically Completes This Form

Organizations and individuals use this form when they need documented consent to feature a person or their content in advertising, promotions, or public case studies.

  • Marketing teams securing testimonial or case-study permissions prior to publication.
  • Sales or client-success staff collecting approval to use client logos or quotes.
  • Legal or compliance teams verifying consent language and retention practices.

Use the form to record scope, duration, and any compensation; retain a copy in your records and attach collateral that was approved.

Step-by-step: Completing the Permission Form

Follow these steps to capture valid, auditable consent that supports legal use and e-sign enforceability.

  • 01
Identify Parties: Enter full legal names for all parties involved.
  • 02
Describe Use: Specify media types, channels, and exact permitted materials.
  • 03
Set Duration: Record the start and end dates or 'perpetual' if applicable.
  • 04
Sign & Date: Collect dated signatures and any witness or guardian approvals.

How to set up the electronic workflow

Configure the e-sign workflow so signature events, timestamps, and consent disclosures are captured and exportable.

Field Configuration
Consent Disclosure Display before signature; require acceptance
Authentication Email link or SMS code for signer verification
Attachment Attach approved creative samples or drafts
Audit Trail Enable IP, timestamp, and action logging

Where to send or file the completed form

Decide routing destinations and archival locations before distribution to ensure consistent recordkeeping and easy retrieval.

  • Marketing Archive: Store signed permissions in the marketing records repository.
  • Customer Record: Attach a copy to the customer's CRM profile.
  • Legal Folder: Place an executed copy in legal/compliance files.
  • Public Assets: Deploy approved content to the specified channels only.

Technical considerations for electronic signing and sharing

Ensure your chosen platform supports required authentication, retention, and export formats before sending the form for signature.

  • Authentication: Email, SMS code, or stronger methods
  • File Formats: PDF/A, DOCX, or image export available
  • Integrations: CRM and cloud storage connections

Verify platform compliance with applicable privacy or industry rules; ensure signed files and audit trails are exported to your records retention system.

Common preparation mistakes to avoid

  • Using vague scope language that fails to specify channels, duration, or exact materials to be used, leading to disputes.
  • Failing to collect guardian consent for minors, which can invalidate permission and create legal exposure.

  • Omitting a withdrawal mechanism or failing to document how withdrawal requests are processed and logged.

Short risks and potential consequences

Breach Claims: Legal exposure
Reputational Harm: Public criticism
Contract Disputes: Cease-and-desist risks

Real-world examples of permission use

These examples show how organizations document consent for marketing use and retain records to support later publication decisions.

Tim Martin, Martin Properties

Tim sought consent from tenants for property photos and testimonials.

  • Permissions specified online and included photo samples.
  • The company retained signed forms and image-release attachments to defend against later disputes and to ensure proper crediting.

John Butler, Fertility Centers of Illinois

The practice requested patient consent for anonymous success stories.

  • Consent included HIPAA-specific language and date range.
  • Completed authorizations were retained for six years and cross-referenced with clinical records for compliance.
