What the Membership Marina Club Agreement Is

The Membership Marina Club is a standardized membership agreement used by marinas to document rights, fees, berth allocations, facility access, and member responsibilities. It typically includes member identification, vessel details, payment terms, insurance requirements, rules of use, term and renewal provisions, and signature blocks. This document governs the contractual relationship between the marina operator and the member and can be executed on paper or electronically when ESIGN and applicable state laws allow electronic records and signatures.

Why a Clear Membership Agreement Matters

A well-drafted Membership Marina Club agreement reduces disputes by documenting obligations, fees, insurance, and rules of conduct. It creates a predictable framework for operations, clarifies renewal and termination terms, and helps protect the marina from liability while ensuring consistent member expectations.

Why a Clear Membership Agreement Matters

Who Typically Prepares and Signs This Agreement

Marinas, yacht clubs, slip managers, and rental operators prepare membership agreements to manage berthing, billing, and access.

  • Marina Operators and Managers: Draft, issue, and enforce club rules and payment schedules for slip and dock management.
  • Individual Boat Owners: Sign to accept berth terms, liability allocations, and fee schedules for assigned slips.
  • Corporate or Fleet Accounts: Authorized company officers or delegated signers execute and manage multiple berth or fleet memberships.

Members, authorized agents, and designated managers normally sign; authorized corporate officers or designated signatories represent business entities.
