TEMPORARY PERMISSION AND METAL-DETECTING AGREEMENT STATE OF _________________ COUNTY OF _______________ For mutual promises and other good and sufficient consideration, the receipt of which is hereby acknowledged, the undersigned Owner does hereby agree that _________________, (hereinafter referred to as “Hobbyist”) subject to the further conditions and requirements set out below in this Agreement, is entitled to temporary rights of ingress and egress to the property (hereinafter the “property”) described as: (Enter description of property/premises to be searched) Conditions and Requirements 1. Limited Purpose. Hobbyist is allowed access to the property for the sole and express purpose of using a metal-detecting device to locate and collect items, artifacts and other materials, which are ordinarily hidden from view due to overgrowth, subsidence, sedimentary deposits or abandoned structures. 2. Indemnification of Owner. Hobbyist shall indemnify the Owner of the property against any and all claims resulting from Hobbyist’s activities pursuant to Article 1 of this Agreement. Such indemnification includes, but is not limited to, personal injuries or property damages sustained by Hobbyist and legal claims which may be made by third parties to this Agreement to those items, articles and other materials located and collected by Hobbyist. Nothing in this Article or in this Agreement shall be construed by either Owner or Hobbyist as limiting the effect or application of any state or federal criminal law to one or the other of them. 3. Retention of Found Items. Unless prohibited by operation of law, Hobbyist shall retain the right to possess and shall be deemed by this Agreement to be given full rights of ownership to the items, artifacts and other materials which may be found by Hobbyist. 4. Condition of Property. Hobbyist shall indemnify and protect Owner from any damage caused by Hobbyist to the real property described herein. Hobbyist shall replace, to the extent practicable, sod or earth removed by digging. 5. Term. The term of this Agreement shall begin on the date hereof and shall expire on the ___day of _______________, 20___. 6. Termination and Cancellation. Owner may terminate and cancel this Agreement with or without notice at any time that Hobbyist’s activities constitute a breach of the peace, cause - 1 - material damage to the property or materially interfere with the normal use of the property by Owner, his agents, family, or assigns.
