What a Military Consignment Agreement Is and When It Applies

A Military Consignment Agreement is a written contract that governs the temporary transfer of military equipment, supplies, or property from a consignor to a consignee for storage, maintenance, sale, or distribution while ownership remains with the consignor. The agreement defines responsibilities for custody, care, insurance, reporting, inspection, and return or disposition of items. It is commonly used where military property, government-funded assets, or defense-related materiel moves between units, contractors, depot facilities, or allied organizations and requires clear chain-of-custody, condition reporting, and compliance with federal procurement and property-accountability rules.

Why a Clear Agreement Protects Property, Compliance, and Liability

A well-drafted Military Consignment Agreement reduces loss and liability by assigning custody duties, insurance requirements, and inspection rights, while clarifying who bears costs for damage, maintenance, or disposition.

Why a Clear Agreement Protects Property, Compliance, and Liability

Who Typically Prepares and Signs This Agreement

Signers should ensure they have authority to bind their organization and that the agreement aligns with applicable procurement and property-accountability regulations.

  • Government Property Managers and Contracting Officers who need documented custody and accountability provisions when placing items with contractors or other agencies.
  • Defense Contractors and Subcontractors receiving consigned materiel for repair, modification, or resale under contract terms and regulatory oversight.
  • Depot Facilities and Warehouses responsible for storage, maintenance, and physical security of consigned government property.

Real-World Examples of Military Consignment Use

Two concise case examples show how agreements handle custody, repair, and disposition in practice.

Depot Repair Consignment

A contractor received avionics for depot-level repair with a detailed NSN list

  • The consignee insured items per contract
  • The agreement required monthly inventory reports and returned items within 30 days after completion, preserving audit logs for contract closeout.

Temporary Storage for Deployment

A unit consigned spare parts to a secure warehouse during deployment

  • The warehouse provided climate control and two-person custody logs
  • On redeployment, items were returned following a joint inspection and signed condition report to avoid liability disputes.

Practical Tips for Accurate, Efficient Consignment Management

Adopt these best practices to reduce disputes, speed audits, and maintain property integrity.

Use Itemized Exhibits
Attach a signed inventory exhibit with serial numbers and photos to avoid later disagreements on condition.
Standardize Reporting
Require consistent reporting templates and digital logs to streamline audits and reconciliations.
Define Inspection Rights
Specify when and how inspections occur and who pays for corrective actions.
Preserve Audit Trails
Keep tamper-evident signed PDFs and exportable audit logs for all executions and changes.
