What the Miscellaneous CD Cushing Template Is

The Miscellaneous CD Cushing Template is a customizable closing disclosure-style document designed to capture settlement charges, prorations, and miscellaneous adjustments for a real estate or loan closing tied to a Cushing transaction. It consolidates buyer, seller, lender, escrow, and property details into a single, printable disclosure that can be used for internal settlement worksheets or distributed to parties for review. The template is not a government form but is commonly used by title companies, closing attorneys, lenders, and brokers to ensure consistent presentation of closing costs and to support recording, funding, and escrow reconciliation processes.

Why this Template Matters for Closings

Using a standardized Miscellaneous CD Cushing Template reduces calculation errors, clarifies responsibility for fees, and creates a clear record for funding and post-closing reconciliation while helping parties meet timing and disclosure expectations.

Why this Template Matters for Closings

Who Typically Uses and Completes This Template

This template is used by several participant types during preparation and closing.

  • Lenders and loan processors — prepare line-item fees, borrower credits, and finance charges for funding packages.
  • Title companies and settlement agents — calculate prorations, escrow deposits, recording fees, and disbursement instructions.
  • Real estate brokers and closing attorneys — review net proceeds, seller adjustments, and any contract-specific credits.

Each participant may fill and retain a copy for their records; the version used at funding should match wiring and disbursement instructions.

Essential Sections to Include in a Professional Template

A robust Miscellaneous CD Cushing Template organizes settlement data into clear sections so every charge and credit is documented, attributed, and totaled for funding and recording.

Transaction Summary

Concise header with property address, loan number, closing date, and parties to the transaction so every page references the correct file and reduces misfiling risk.

Buyer Charges

Line-by-line buyer liabilities including loan costs, prepaid items, escrow deposits, and prorations with spaces for payer and responsible party notes.

Seller Adjustments

Itemized seller credits, payoff amounts, prorations for taxes or utilities, and payoff instructions for mortgages or liens.

Title and Recording Fees

Space for title premium, endorsements, recording fees, transfer taxes, and county-specific line items that impact net proceeds.

Escrow & Disbursement

Detailed disbursement schedule showing payee names, amounts, and wiring or check instructions to ensure accurate settlement.

Totals & Certification

Clear subtotal and grand total rows plus a certification line for preparer name, contact, signature, and date.

Step-by-Step: How to Complete the Template

Follow these steps in order to prepare an accurate disclosure and minimize settlement delays.

  • 01
    1. Gather Documents: Collect contract, mortgage payoff statements, prior closing statements.
  • 02
    2. Enter Header Data: Populate property, parties, and effective date fields first.
  • 03
    3. Itemize Charges: Add buyer and seller line items with supporting calculations.
  • 04
    4. Reconcile Totals: Confirm sums match payoffs and escrow requirements.

How to Configure an Online Completion Workflow

Set up a digital workflow to route the template for review and signature while preserving audit data and version history.

Field Configuration
Signature Field Require signer name, date, and IP/timestamp capture.
Reviewer Order Set role-based sequential routing (title → lender → buyer).
Authentication Enable email or SMS code signer verification.
Document Versioning Enable automatic version history and PDF flattening on finalization.

Where to Send or File the Completed Template

After finalization, route copies to each participant and retain a signed version for escrow and funding.

  • Settlement Agent: Send a signed PDF and settlement instructions for fund disbursement.
  • Lender / Loan Servicer: Provide final figures to the lender for funding and payoff verification.
  • Recorder's Office: Submit required signed deeds and documents for recording, per county procedures.
  • Parties / Agents: Distribute copies to buyer, seller, and their representatives for records.

Technical and Platform Requirements for Digital Use

Choose tools that preserve PDF fidelity, capture audit trails, and support signer authentication appropriate to the transaction.

  • File Formats: PDF/A or PDF with fillable fields for consistent rendering.
  • Authentication: Email, SMS code, or stronger MFA depending on risk.
  • Integrations: Support for CRM, closing platforms, and cloud storage.

Use platforms that record timestamps, IP addresses, and version history; ensure the provider can meet industry compliance needs such as HIPAA or 21 CFR Part 11 when relevant.

Common Timelines and Deadlines to Keep in Mind

Timely delivery and review of the disclosure reduce the risk of rescheduling and regulatory issues; observe both contractual and regulatory timing requirements.

Disclosure Delivery Window:

Provide final disclosure at least three business days before scheduled consummation.

Review Period:

Allow parties at least three business days to review before signing.

Recording Timeline:

Record deeds and related instruments per county timelines to avoid marketability delays.

Funding Cutoffs:

Confirm lender wire deadlines to ensure same-day funding.

Retention Start:

Retention begins on the execution or recording date, depending on document type.

Key Milestones from Draft to Funding

Track these sequential milestones to ensure a coordinated closing and to document each stage for auditability.

01

Draft Prepared

Initial calculation and internal review of line items and prorations.

02

Internal Approval

Title and lender confirm final figures and payoffs.

03

Delivery to Parties

Distribute for buyer and seller review within the required window.

04

Funding & Recording

Common Preparation Errors to Avoid

  • Mismatched names or addresses that cause recording delays and additional title searches or corrected instruments.
  • Incorrect prorations or tax calculations that alter net proceeds and require post-closing adjustments.
  • Missing payee or wire instructions leading to returned funds or delayed disbursements.
  • Failure to capture signer attribution (email, IP, timestamp) that weakens audit evidence of intent.

Risks and Consequences of an Incorrect Template

Funding Delays: May require rescheduling and additional lender conditions.
Recording Rejections: County clerk errors can force re-execution and extra fees.
Financial Exposure: Incorrect payoffs or taxes can create liability for the preparer.
Regulatory Scrutiny: Consumer mortgage disclosures not meeting timing rules risk administrative penalties.
Title Issues: Unresolved liens due to inaccurate payoffs may cloud marketability.
Reputational Harm: Repeated errors undermine trust with lenders and clients.

Supporting Documents to Include with the Template

Attach or reference core supporting documents to substantiate line items and to streamline funding and post-closing audits.

Payoff Statements

Provide lender payoff statements for any mortgage or lien to substantiate payoff amounts and to avoid reconciliation discrepancies at funding.

Purchase Contract

Include the executed contract to reference agreed credits, prorations, and obligations tied to the transaction terms.

Title Policy

Attach preliminary title report and commitments to confirm premium calculations and endorsements.

Wiring Instructions

Supply verified wire instructions for funds distribution; verify with payees by phone or secure channel to prevent fraud.
