What the Miscellaneous Form 843 Is and when it applies

Miscellaneous Form 843 is the Internal Revenue Service form used to request abatements, claim refunds, or correct certain taxes, penalties, and interest that were paid or assessed in error. Common uses include requesting a refund for payroll taxes, abating penalties assessed for late filing or payment, and correcting assessed interest or certain excise taxes. The form requires a clear statement of the error or basis for relief, supporting documentation, and the taxpayer's signature. Filing Form 843 follows IRS rules for claims and may affect statute of limitations and refund timing.

Why completing Form 843 accurately matters

Using Form 843 creates an official IRS record of your request for refund or abatement, consolidates supporting evidence, and gives the IRS the information needed to evaluate relief; accurate, complete submissions reduce delays and the risk of outright denial.

Why completing Form 843 accurately matters

Who commonly prepares and files Form 843

Employers, businesses, fiduciaries, tax practitioners, and individual taxpayers file Form 843 to request refunds or abatement of assessed taxes or penalties.

  • Small employers correcting payroll tax overpayments or requesting abatement of employment tax penalties.
  • Tax practitioners submitting claims on behalf of clients after administrative review or discovery of error.
  • Government contractors and exempt organizations challenging assessed excise or miscellaneous taxes.

Ensure the filer is authorized to act for the taxpayer and include power-of-attorney documentation when a representative files on behalf of the taxpayer.

The claimant or authorized representative must sign and date the form; include a power of attorney (Form 2848) if a third party files on the taxpayer's behalf.

Common mistakes that delay or derail Form 843 claims

  • Failing to attach required notices and schedules often leads to automatic denial or requests for additional information that extend processing timelines.
  • Providing mismatched taxpayer names or incorrect EINs triggers identity verification delays and can result in the IRS refusing to accept the claim.
  • Submitting claims after the applicable statute of limitations has expired often occurs because filers misunderstand when the limitation period begins.
  • Using Form 843 for matters outside its scope, such as routine refunds better handled on amended returns (Form 1040X) or amended payroll returns, creates unnecessary denial risk.
