What the Miscellaneous G-639 Document Is

The Miscellaneous G-639 Document is the U.S. Citizenship and Immigration Services (USCIS) form used to make a Freedom of Information Act (FOIA) or Privacy Act request for records held by USCIS. It lets individuals, attorneys, and organizations request copies of immigration files, background records, or application materials. The request must identify the records sought, provide proof of identity or legal authority, and indicate delivery preferences. FOIA and the Privacy Act give requestors statutory rights to access and correct records, subject to exemptions and redactions under federal law (5 U.S.C. §552; 5 U.S.C. §552a).

Stepwise Process for Preparing and Submitting the G-639

Follow these sequential steps to assemble a complete G-639 submission and reduce processing delays.

  • 01
Assemble IDs: Collect government photo ID and any authorizing documentation.

Why Use the G-639 for Accessing USCIS Records

The G-639 provides a standardized, legally recognized method to obtain or correct immigration records, ensuring requests include necessary identity and specificity to start a search.

Why Use the G-639 for Accessing USCIS Records

Who Typically Files a G-639

Each user type must demonstrate identity or authority; representatives should include signed client consent or power-of-attorney documents when applicable.

  • Individuals requesting their own immigration files for personal review, benefit applications, or corrections to records.
  • Attorneys and accredited representatives requesting client records to support immigration filings or appeals.
  • Researchers or freedom of information advocates requesting aggregated or de-identified data for study or oversight.

Core Elements to Include on Every G-639 Submission

Ensure these six components are present to make your request complete and actionable for agency processing.

Request Type

State whether the submission is a FOIA request, a Privacy Act request, or both; this determines statutory pathways and release rules for the records requested.

Specific Records

Provide form numbers, receipt numbers, filing dates, locations, and subject names to narrow the search and reduce search time and duplication fees.

Identity Proof

Attach a clear copy of government-issued photo ID and, for third-party requests, include client consent or legal authorization to avoid processing rejections.

Fee Statement

If you anticipate search or duplication charges, state whether you will pay fees, seek a fee waiver, or limit the scope to avoid charges.

Contact Details

Provide current postal and email addresses and daytime phone numbers so the agency can request clarifications or notify you promptly of processing status.

Signature and Date

Signed and dated attestation by the requester or authorized representative is essential; unsigned forms are commonly returned as incomplete.

Security and Compliance Considerations for Electronic G-639 Submissions

Encryption: TLS 1.2/1.3; AES-256 at rest
Audit Trail: Timestamps and IP logs retained
HIPAA Handling: BAA required for PHI transmission
Access Controls: Role-based access for records
Retention Policy: Preserve original request and proofs
Standards: SOC 2 Type II and ISO 27001

Common Errors and Risks When Filing a G-639

Incomplete ID: Delays or rejection
Vague Request: Extended search time
Missing Signature: Returned as incomplete
Unauthorized Request: Privacy Act denial
Fee Surprise: Unexpected duplication charges
Data Exposure: Inadequate redaction risk

End-to-end Flow: From Preparation to Receipt of Records

A concise four-step view of a typical G-639 request lifecycle from sender to agency and back to the requester.

  • Prepare Request: Complete the form, attach ID, and specify record details.
  • Submit to USCIS: Send per USCIS FOIA office instructions and retain submission proof.
  • Agency Processing: USCIS searches records, applies redactions, and determines fees.
  • Receive Response: Agency returns records, fee notice, or denial with appeal rights.

Key Deadlines and Timing Expectations for FOIA/Privacy Act Requests

Timing shown reflects federal FOIA frameworks and common agency practice; complex requests and consultations can extend these periods.

Initial Acknowledgment:

Acknowledgment typically within days of receipt; varies by agency.

Statutory Response Window:

Agencies normally respond within statutory timeframes under FOIA 5 U.S.C. §552, often 20 business days, subject to extensions.

Fee Notification:

If search or duplication fees apply, USCIS will notify and request payment authorization.

Administrative Appeal Deadline:

Appeal and litigation deadlines are strict; follow agency denial notice for timing.

Complexity Extensions:

Consultations or voluminous searches commonly extend processing by weeks or months.

Practical Examples of Common G-639 Requests

Two concise, realistic scenarios illustrating how typical requests are framed and what outcomes to expect.

Individual Record Request

A person requests their complete USCIS file to support a green card application, including receipt numbers and dates

  • Request is limited to specified years to reduce search time
  • The agency provides a redacted copy within the FOIA response, identifies fees, and notes any withheld records with exemption explanations.

Attorney Case Retrieval

An attorney requests client files to prepare an appeal, attaching signed client authorization and bar ID

  • Request includes specific receipt numbers and FOIA waiver justification
  • USCIS locates responsive records, charges minimal duplication fees, and returns certified copies for case use.

Practical Tips to Speed Processing and Reduce Costs

Adopt these practices before submission to limit search scope, avoid fees, and simplify identity verification.

Be as specific as possible
List receipt numbers, form types, dates, and locations. A narrowly scoped request reduces search time, lowers duplication fees, and shortens agency processing cycles.
Provide clear identity proof
Attach a high-quality copy of government-issued ID; for third-party requests include signed authorization. Clear documentation prevents return-for-correction delays.
Request electronic delivery
Choose secure email or encrypted downloads to receive documents faster and avoid postal delays. Electronic delivery also reduces postage and handling fees.
Ask for a fee waiver when appropriate
If you qualify under statutory fee-waiver criteria, provide a concise justification to avoid unnecessary cost assessments and speed processing.
