What the Miscellaneous G28 Document Is and when it applies

The Miscellaneous G28 Document is used to notify U.S. immigration authorities that an attorney or accredited representative will appear on behalf of an applicant or petitioner. It records the representative's name, contact information, and the scope of representation and is typically submitted with an underlying USCIS filing or as an attachment to existing immigration case records. Though related to federal immigration processes, it can affect procedural rights, service of notices, and official correspondence routing and therefore must accurately reflect the representative and client information.

Why a clear Miscellaneous G28 Document matters

Accurate completion ensures USCIS recognizes a representative and directs official communications correctly, reduces delays from mistaken contacts, and helps preserve client rights during adjudication. Properly completed forms clarify who may receive notices, respond to RFEs, and represent the applicant at interviews.

Why a clear Miscellaneous G28 Document matters

Who typically completes or signs this G28 variant

Ensure the signer has appropriate authority; incorrect or unsigned G28 documents can delay notices and responses from USCIS.

  • Immigration law firms preparing case filings and responses on behalf of petitioners and applicants.
  • Nonprofit accredited representatives documenting limited-scope representation for asylum or humanitarian matters.
  • Pro se filers who subsequently retain counsel and need to record change of representation.

Representative profiles and practical notes

Immigration Attorney

An attorney licensed in at least one U.S. jurisdiction who signs to represent a client before USCIS. Include bar number, firm contact, and written authorization. Accurate contact details ensure timely receipt of USCIS correspondence and allow attorney to respond to RFEs and notices.

Accredited Representative

An accredited non-attorney representative recognized by DOJ/EOIR or an organization with accreditation. Provide accreditation evidence and organization details. Errors here may cause USCIS to reject representation claims or return notices to the applicant.

Step-by-step: Completing the Miscellaneous G28 Document

Follow this concise sequence to prepare, review, and attach the G28 document correctly when filing or updating representation.

  • 01
Collect details: Gather full legal names, addresses, bar or accreditation numbers, and client identifiers.
  • 02
Complete fields: Enter representative and client information exactly as issued on IDs.
  • 03
Sign and date: Representative signs and dates; client signature when required.
  • 04
Attach to filing: Include with underlying USCIS form or submit according to agency instructions.

Configuring a digital workflow for G28 attachments

When sending a G28 as part of an electronic filing package, set the workflow options below to ensure reliable delivery and auditability.

Field Configuration
Signer order Representative signs first, client signs if required.
Authentication Use email verification or SMS code for signer identity.
Reminders Enable auto-reminders at scheduled intervals.
Record retention Save a signed audit trail and PDF copy automatically.

Digital submission: platform and file requirements

Ensure the platform you choose supports secure storage, provides a tamper-evident audit trail, and meets any agency submission format requirements.

  • File formats: PDF/A or PDF recommended.
  • Signer metadata: Capture IP, timestamp, and email.
  • Integration needs: Support for USCIS e-filing attachments.

Typical digital submission flow for a G28 document

This sequence describes a common path for preparing, signing, and attaching a G28 to an electronic filing or correspondence package.

  • Prepare package: Upload primary form and supporting documents.
  • Place fields: Add signature, date, and representative fields.
  • Send for signature: Deliver via secure email link or portal.
  • Store final copy: Archive signed PDF and audit trail.

Essential elements to include on a professional G28 attachment

Ensure every G28 attachment contains the following items to meet agency expectations and to document representation clearly.

Representative identity

Full name, title, firm or organization association, and identifying number such as bar or accreditation number so USCIS can verify authority to act.

Client identifiers

Applicant or petitioner's USCIS receipt numbers, A-number, date of birth, and full legal name to link the G28 to the correct case record accurately.

Contact information

Representative mailing address, phone, and email for delivery of official correspondence and service of notices without ambiguity or delay.

Scope and limitations

A clear statement whether representation covers all matters related to the case or limited actions, reducing later disputes over authority.

Signature and date

Representative signature, date in MM/DD/YYYY format, and any client signature when the form or local rules require joint acknowledgment.

Attachments and exhibits

Include power-of-attorney letters, accreditation evidence, or proof of authorization when representation requires additional documentation for acceptance.

Supporting documentation often required with a G28

Attaching supporting documents can prevent requests for evidence and prove the representative's authority when questioned by the agency.

Accreditation proof

Copies of accreditation certificates or organization letters confirming non-attorney representative status when applicable, including DOJ or EOIR recognition.

Power of attorney

A limited or general power of attorney if the client authorizes specific actions; include notarization only when the underlying filing requires it.

Firm authorization

Internal firm letter confirming the representative's authority to act on the client's behalf, especially for large organizations or multi-practitioner filings.

Case linkage

Printed receipt notices, previous USCIS correspondence, or client identifiers to ensure the G28 attaches to the correct underlying petition or application.

Best practices to reduce processing friction

Adopt consistent verification, formatting, and storage habits to avoid rejections and ensure USCIS recognizes representation without delay.

Always confirm signer identity and authority
Verify bar or accreditation numbers before submission, and maintain copies of credentials. This prevents disputes about representation and reduces risk of notice misdirection during adjudication.
Use consistent client identifiers across filings
Match names, A-numbers, and receipt numbers exactly with underlying forms. Consistency avoids misfiled attachments and speeds case matching by agency staff.
Maintain an auditable signature trail
Capture timestamps, IP addresses, and authentication evidence for all electronic signatures to support attribution and to comply with ESIGN and UETA principles.
Store a master copy with supporting exhibits
Retain the signed PDF and any attached accreditation or authorization records in a secure, access-controlled system for the duration of the case and applicable retention period.

Timing considerations and related filing deadlines to remember

The G28 is commonly filed with other forms; meet the deadlines for the primary filing and preserve response timelines for agency requests.

W-9 and tax forms timing:

W-9 is provided upon request; no fixed filing deadline for the payer to request it.

1099-NEC recipient/IRS deadline:

Form 1099-NEC due to recipient and IRS by January 31 each year.

1099-MISC IRS deadlines:

Recipient copies by January 31; paper to IRS by February 28; electronic to IRS by March 31.

Individual tax return deadline:

Form 1040 due April 15; extension with Form 4868 extends filing to October 15.

USCIS filing windows:

Follow the submission deadlines on the form instructions; some petitions require filing within specific program windows.
