What the Miscellaneous OF 306 Form Is and when it’s used

The Miscellaneous OF 306 Form, commonly known as the Declaration for Federal Employment (OF-306), is a standardized U.S. federal form used to collect background, criminal-history, and employment-related disclosures from job applicants and current federal employees. Agencies use the form to evaluate suitability, fitness for duty, and clearance-related considerations as part of hiring, position changes, or suitability reviews. The form typically asks about convictions, pending charges, prior federal employment separations, conflicts of interest, and similar matters. Responses are treated as part of an official personnel record and can affect hiring or retention decisions.

Why accurate completion of the OF 306 matters

Completing the OF 306 accurately ensures a timely suitability review and reduces the risk of employment delays or adverse administrative actions. Accurate disclosures protect applicants by aligning expectations with agency suitability standards and help agencies meet legal and security obligations.

Why accurate completion of the OF 306 matters

Primary users and those who handle the OF 306

The OF 306 is used across federal human resources, hiring managers, security offices, and applicants for federal employment.

  • Applicants and candidates completing pre-employment screening and suitability questionnaires.
  • HR specialists and personnel security officers who review disclosures and make suitability recommendations.
  • Hiring managers and appointing authorities who rely on the form for final employment decisions.

Different stakeholders must treat the form as an official personnel record; agencies commonly combine OF 306 disclosures with background investigations and other vetting materials.

Core sections you’ll find on the OF 306

Understanding the form’s structure helps you prepare answers and gather supporting documents before you begin. The OF 306 is concise but covers personal identification, employment history, criminal and legal questions, and a final declaration and signature block.

Personal Data

Name, contact information, DOB, SSN or agency ID for identity verification and record-matching.

Employment History

Recent employer names, job titles, and dates to validate experience and prior separations.

Criminal and Legal Questions

Convictions, pending charges, and related legal matters that agencies review for suitability.

Administrative History

Prior federal employment actions, terminations, resignations in lieu of discipline, and similar disclosures.

Conflict Disclosures

Conflicts of interest, financial interests, or outside employment that may affect duties.

Certification and Signature

Signed declaration under penalty of law attesting to completeness and truthfulness of responses.

Step-by-step: completing and submitting the OF 306

Use this sequential checklist to prepare, complete, and transmit the OF 306 to a federal hiring office or HR representative.

  • 01
Gather documents: Collect IDs, employment records, and court documentation to verify answers.
  • 02
Answer each question: Provide truthful, concise responses; expand in attached explanations if needed.
  • 03
Review for accuracy: Proofread names, dates, and SSN before signing to avoid processing delays.
  • 04
Submit per agency instruction: Transmit the completed form as directed — secure upload, HR portal, or signed physical copy.

Typical processing flow after submission

After you submit an OF 306, agencies follow standard verification and adjudication steps as part of hiring or suitability processes.

  • Intake: HR records submission and initial completeness check.
  • Verification: Background checks and record-matching against criminal and employment databases.
  • Adjudication: Security or suitability officer evaluates disclosures and investigation results.
  • Outcome: Hiring decision, clearance determination, or request for clarification or additional documentation.

Common agency routing configurations for electronic OF 306 submissions

Agencies may implement specific workflow settings for secure intake, reviewer assignments, and retention. Confirm agency guidance before using electronic submission.

Field Configuration
Intake method Secure HR portal | email discouraged
Authentication PIV/CAC or multi-factor for sensitive access
Reviewer roles HR clerk | security officer | hiring official
Retention Follow agency record schedule

Technical considerations for electronic completion and submission

Ensure the chosen submission method meets agency authentication and record-retention requirements before sending an OF 306 electronically.

  • Supported formats: PDF and scanned images are commonly accepted; follow agency guidance.
  • Authentication levels: Higher-assurance methods (PIV/CAC or MFA) are preferred for personnel records.
  • Audit trail: Maintain timestamps, signer identity, and access logs for the record.

Coordinate with the hiring agency to confirm acceptable e-signature methods and secure transmission channels for sensitive personnel records.

Timing expectations and common deadlines

Agencies set submission and response windows for OF 306 as part of job offers, onboarding, or suitability reviews. Meeting those timelines prevents hiring delays.

Offer contingencies:

Respond within the deadline in the conditional offer or the offer may be rescinded.

Background checks:

Investigations vary; some checks complete in days, others take weeks.

Requests for clarification:

Agencies often allow 7–14 days to provide supporting documentation.

Record retention:

Keep supporting records until agency confirms final adjudication.

Appeals or rebuttals:

Follow agency-specific timeframes for responding to adverse determinations.

Key milestones in the OF 306 processing timeline

This sequential milestone list outlines typical stages from submission to final suitability determination.

01

Submission

Applicant returns completed OF 306 to HR or uploads it to the secure portal.

02

Completeness check

HR verifies all required fields and requests missing items.

03

Background investigation

Agency initiates checks and collects corroborating records.

04

Adjudication & decision

Security or HR adjudicator issues a suitability determination.

Common mistakes to avoid when completing OF 306

  • Leaving fields blank rather than providing a short explanation can trigger follow-up and delay decisions.
  • Using inconsistent name formats across documents (nickname vs legal name) that impede background checks.
  • Failing to disclose convictions or separations that later surface during investigation, risking adverse action.
  • Submitting scans with missing pages or illegible handwriting, causing rejection or request for resubmission.

Consequences of inaccurate or incomplete OF 306 responses

Employment delay: Processing and onboarding may be postponed pending clarification.
Offer withdrawal: A conditional offer can be rescinded for material omissions or misrepresentations.
Disciplinary action: Existing employees may face administrative actions for falsified disclosures.
Suitability denial: Security or fitness adjudication can result in denial of appointment.
Legal exposure: False statements on an official government form may carry legal penalties.
Record impact: Negative adjudications are retained in personnel records and can affect future employment.
