CIVIL ACTION NO.             DEFENDANT ALTERNATIVE CHILD SUPPORT PAYMENT AGREEMENT WHEREAS, the undersigned are the parties to the divorce proceeding in the above-styled and numbered action; and, WHEREAS,       shall be termed and identifed as the "custodial parent" and       shall be termed and identifed as the "noncustodial parent", as those labels and terms are defned, set out and used in M.C.A. (Supp. 1994) § 93-11-103; and, WHEREAS, the undersigned have elected, as provided in M.C.A. (Supp. 1994) § 93-11-103, to select an alternative arrangement for the payment of child support by the non-custodial parent to the custodial parent, rather than the entry of an immediate Withholding Order upon the entry of a Judgment of Divorce between the parties. NOW, THEREFORE, IN CONSIDERATION of the promises and covenants contained in the Marital Dissolution Agreement between these parties dated the       day of       , which the parties contemplate will be attached to and incorporated in their Judgment of Divorce, and their mutual election to provide an alternative arrangement for the payment of child support from the non-custodial parent to the custodial parent, the undesigned agree to the method of child support payments as follows: 1. Said child support payments shall be in the form of cash, personal check, bank check, or money order. If paid by any form of check and said check is returned and not paid for any reason, non-custodial parent shall pay custodial parent any costs, losses, charges or expenses, including, but not limited to, reasonable attorney's fees, incurred by custodial parent as a result of the return of any such check. 4. In the event that non-custodial parent shall not strictly adhere to the terms of this agreement, and she shall become thirty days delinquent in the payment of any installment of child support as contemplated herein, then custodial parent shall have the right to seek the entry of an immediate Withholding Order as contemplated and provided in M.C.A. (Supp. 1994) §93-11-103, or any other statute or provision of law. 5. The term "non-custodial parent" shall also mean "obligor" and the term "custodial parent" shall also mean "obligee" as contemplated, defned and used in M.C.A. (Supp. 1994) §93-11-103.
