MOBILE HOME PARK LEASE AGREEMENT

This Mobile Home Park Lease Agreement ("Agreement") is made and entered into on between Landlord Name: (hereinafter "Landlord") and Tenant Name: (hereinafter "Tenant"). Landlord and Tenant are collectively referred to as the "Parties."

Security deposit shall be held in accordance with applicable law. Landlord may apply deposit to unpaid rent, repairs for damage beyond normal wear and tear, and other sums owed by Tenant under this Agreement. Any balance due to Tenant shall be returned as required by law within the statutory timeframe.

Utilities, Services and Taxes

Utilities and services provided by Landlord:

Tenant shall be responsible for payment of utilities and services not expressly provided by Landlord and shall not permit utilities to be disconnected. Tenant shall not cause any charge or lien against the Park or lot for utilities, except as expressly authorized in writing by Landlord.

The premises shall be used solely for the placement and residential occupancy of one mobile/manufactured home owned by Tenant. Tenant shall not operate any business or commercial enterprise from the lot without prior written consent of Landlord. Tenant shall keep the mobile home serial/VIN:

Maintenance, Repairs and Alterations

Tenant shall maintain the mobile home and the immediate lot area in a clean, safe and sanitary condition. Tenant shall be responsible for all repairs to the mobile home and appurtenances unless such repairs are caused solely by Landlord's negligence. Tenant shall not make structural alterations, affix permanent additions, or change utilities without Landlord's prior written consent. Landlord may enter the lot at reasonable hours for inspection, maintenance, or emergency repairs after providing notice as required by law.

Pets, Vehicles and Nuisance

Pet Policy:

Vehicle Restrictions: Tenant shall register vehicles with Landlord and shall not park more than: on the lot. Recreational vehicles, commercial vehicles, and inoperable vehicles are subject to Park rules.

Rules, Regulations and Compliance

Tenant agrees to comply with all reasonable written Park Rules and Regulations provided by Landlord, as amended from time to time, which are incorporated into this Agreement. Tenant shall not engage in any illegal activity on the premises. Tenant shall permit inspection of the mobile home connection and anchoring systems and shall comply with applicable governmental standards for placement, tie-down and utility connections.

Insurance and Indemnity

Tenant shall maintain liability insurance covering Tenant's occupancy of the lot and the mobile home, naming Landlord as an additional insured where required by Landlord. Tenant shall provide proof of insurance upon request. Tenant agrees to indemnify and hold Landlord harmless from and against all claims arising out of Tenant's negligent use or occupancy, except to the extent caused by Landlord's gross negligence or willful misconduct.

Default, Remedies and Termination

If Tenant fails to pay rent when due or otherwise breaches this Agreement, Landlord shall provide written notice specifying the nature of the default and the time to cure as required by law. If Tenant fails to cure within the required period, Landlord may terminate the tenancy and pursue any remedies available under applicable law, including recovery of unpaid rent, damages, costs of removal of the mobile home if authorized, and reasonable attorneys' fees and costs incurred in enforcing Landlord's rights.

If Landlord fails to perform material obligations, Tenant may provide written notice to Landlord and allow Landlord the opportunity to cure. Tenant's remedies for uncured default by Landlord are limited to those provided by statute and this Agreement, and Tenant shall not withhold rent except as expressly permitted by applicable law.

Assignment and Subletting

Tenant shall not assign this Agreement or sublet the lot without Landlord's prior written consent, which consent shall not be unreasonably withheld. Any assignment or subletting without written consent shall be void and constitute a breach of this Agreement.

Notices

Notices required under this Agreement shall be in writing and delivered in person or sent by certified mail, return receipt requested, or by any other method permitted by law to the notice addresses above (or to such other addresses as a Party designates by written notice to the other).

Governing Law; Entire Agreement

This Agreement shall be governed by and construed in accordance with the laws of the state where the Park is located. This Agreement contains the entire agreement of the Parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements and understandings, oral or written. Any modification of this Agreement must be in writing and signed by both Parties.

Severability; Attorneys' Fees

If any provision of this Agreement is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. In any action to enforce the terms of this Agreement, the prevailing party shall be entitled to recover reasonable attorneys' fees and costs.
