MONTH TO MONTH LEASE RIDER

This Month to Month Lease Rider (the Rider) is made effective as of , by and between Landlord Name: and Tenant Name: .

RECITALS

WHEREAS, Landlord and Tenant entered into a written Residential Lease Agreement dated (the Lease) concerning the premises located at (the Premises).

WHEREAS, the parties desire to convert the Lease to a month-to-month tenancy and to memorialize the agreed modifications while leaving all other terms of the Lease in full force and effect except as specifically modified by this Rider.

NOW, THEREFORE, in consideration of the mutual covenants and agreements contained herein and other good and valuable consideration, the receipt and sufficiency of which are acknowledged, the parties agree as follows:

1. TERM; CONVERSION

1.1 Conversion to Month-to-Month. Effective as of the date first written above, the Lease shall continue as a tenancy from month to month (the Term) and shall automatically renew on a month-to-month basis until terminated in accordance with this Rider.

1.2 Termination. Either party may terminate the month-to-month tenancy by providing written notice to the other party not less than days prior to the intended termination date, unless a different notice period is required by law, in which case the longer notice period shall govern.

2. RENT

2.1 Rent Amount. Rent shall be due each month in the amount of $ and shall be paid in accordance with the payment terms provided in the Lease, subject to any changes set forth in this Rider.

2.2 Rent Adjustment. Landlord may increase Rent upon providing Tenant with written notice of a rent increase at least the notice period stated in Section 1.2 above. Any rent increase shall be effective only after the expiration of the required notice period and as permitted by applicable law.

3. SECURITY DEPOSIT

3.1 Existing Deposit. The security deposit held under the Lease in the amount of $ shall remain in full force and shall continue to secure Tenant's obligations under the Lease and this Rider.

4. UTILITIES, SERVICES, AND CHARGES

4.1 Responsibility. Tenant shall remain responsible for payment of utilities and services as set forth in the Lease. Any change in responsibility for utilities or services shall be documented in writing and signed by both parties.

4.2 Late Charges and Fees. All late charges, returned-check fees, and other charges set forth in the Lease shall continue to apply during the Term, provided such charges comply with applicable law.

5. MAINTENANCE AND REPAIRS; ENTRY

5.1 Tenant Obligations. Tenant shall continue to maintain the Premises and perform repairs required of Tenant under the Lease. Tenant shall promptly notify Landlord of conditions requiring Landlord's attention.

5.2 Landlord Entry. Landlord may enter the Premises for inspection, repairs, or showings in accordance with the Lease and applicable law; Landlord shall provide the notice required by law or by the Lease prior to entry unless an emergency exists.

6. DEFAULT; REMEDIES

6.1 Default. A material breach by Tenant of any obligation of the Lease or this Rider shall constitute a default. Remedies available to Landlord for Tenant default include termination of tenancy, recovery of possession, damages, and other relief permitted by the Lease or applicable law.

6.2 Cure Periods. Where the Lease provides a cure period for breaches, such cure period shall apply to defaults under this Rider unless otherwise provided in a written notice in accordance with Section 9 (Notices).

7. NOTICES

All notices required or permitted under the Lease or this Rider shall be delivered to the addresses below (or to such other address as a party designates by written notice). Delivery methods shall include personal delivery, certified mail (return receipt requested), or other method permitted by law.

8. GOVERNING LAW; VENUE

This Rider shall be governed by and construed in accordance with the laws of the state in which the Premises are located. Venue for any action arising out of this Rider shall lie in the state or federal court with jurisdiction over the county where the Premises are located.

9. ENTIRE AGREEMENT; SEVERABILITY

9.1 Entire Agreement. Except as expressly modified by this Rider, all terms and provisions of the Lease remain in full force and effect. This Rider and the Lease constitute the entire agreement between the parties with respect to the subject matter hereof.

9.2 Severability. If any provision of this Rider is held to be invalid or unenforceable, the remainder of this Rider shall continue in full force and effect and shall be interpreted to carry out the parties' intentions to the fullest extent permitted by law.

10. AMENDMENTS; WAIVER; COUNTERPARTS

10.1 Amendments. This Rider may be amended only by a writing signed by both parties. No course of dealing or failure to exercise a right shall constitute an amendment or waiver.

10.2 Waiver. The waiver of any provision or right shall not be construed as a waiver of any other provision or right or of any subsequent breach.

10.3 Counterparts. This Rider may be executed in counterparts, each of which shall be deemed an original and all of which taken together shall constitute one and the same instrument.

11. MISCELLANEOUS PROVISIONS

11.1 Succession and Assignment. This Rider shall bind and inure to the benefit of the parties and their respective heirs, successors and permitted assigns. Tenant may not assign the Lease or sublet the Premises except as allowed by the Lease and applicable law.

11.2 Compliance with Law. Tenant shall comply with all applicable laws, ordinances and regulations relating to the use and occupancy of the Premises. Landlord shall comply with landlord obligations imposed by applicable law.

ACKNOWLEDGMENT

The parties acknowledge that they have read this Rider, understand its terms, and agree that it modifies the Lease as set forth above. Except as expressly modified by this Rider, all other terms and conditions of the Lease remain unchanged and in full force and effect.
