MOVING SERVICES AGREEMENT

Recitals

WHEREAS, Client requires professional moving and related services for the relocation of household or commercial goods as described in this Agreement;

WHEREAS, Mover represents that it is duly qualified, licensed, and insured to perform moving services and has agreed to perform such services under the terms set forth in this Agreement; and

WHEREAS, the parties desire to set forth the terms and conditions governing the performance, payment and liabilities associated with the moving services.

Scope of Work

Mover will provide the services described below. Services include loading, transportation, unloading and any additional services expressly selected below. Mover will use reasonable care in the handling of Client's property but will not be responsible for goods not disclosed or for items of unusual susceptibility to damage unless packed by Mover.

Insurance and Liability

Mover's liability for loss or damage is limited as provided in this Agreement and by applicable law. Client is advised to obtain separate insurance if greater coverage is desired. Mover shall not be liable for loss or damage caused by improper packing by Client, inherent vice, normal wear and tear, or delay.

Change Orders and Additional Charges

Any changes to the Scope of Work, including additional services, extra stops, access issues, or changed addresses, may result in additional charges. All change orders must be documented in writing and signed by both parties prior to performance when practicable. Client is responsible for additional charges incurred due to failed planning, permits, or property conditions that were not disclosed.

Cancellation; Term and Termination

This Agreement commences on the Start Date and continues until completion of the services or the End Date set forth below, unless earlier terminated in accordance with this section.

Either party may terminate this Agreement for material breach if the breaching party fails to cure within days after written notice. Client cancellation within 48 hours of scheduled service may incur a cancellation fee up to the deposited amount or a specified percentage of the estimated charge to cover reasonable costs.

Confidentiality

Each party shall keep confidential and not disclose to third parties any non-public business or personal information obtained from the other party in connection with this Agreement, except as required by law or as reasonably necessary for performance hereunder. Confidential information does not include information that is or becomes publicly available without breach of this Agreement.

Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the state of without regard to conflict of laws principles. Any dispute arising out of or relating to this Agreement shall be resolved in the state and federal courts located in that state, subject to any agreement the parties may enter for alternative dispute resolution.

Entire Agreement; Severability

This Agreement, including any written attachments, estimates, or change orders signed by both parties, constitutes the entire agreement between the parties with respect to the subject matter and supersedes all prior negotiations and understandings. If any provision of this Agreement is held invalid or unenforceable, the remaining provisions remain in full force and effect.
