SURFACE TENANT’S CONSENT AND SUBORDINATION(To Storage Lease) STATE: COUNTY: TENANT: (Name and Address) OPERATOR: (Name and Address) EFFECTIVE DATE: On (Date of Lease) ____, as Lessor, executed a Storage Lease (the “Lease”) to ____, as Lessee. The Lease is recorded in Volume ____, page ____ of the ____ Records of the state and county named above. It covers the following land (the “Land”) located in the stat e and county named above: (Description of Land) Tenant is the lessee under a (Surface Use Lease, Agricultural Lease, Grazing Lease , etc.) dated __________, which covers all or a portion of the Land. Operator, the owner of the Lease, desires that Tenant subordinate Tenant's rights under the (Surface Use Lease, Agricultural Lease, Grazing Lease, etc.) to the leasehold estate and rights created by the Lease. For adequate consideration, Tenant subordinates all rights and privileges under the (Surface Lease, Agricultural Lease, Grazing Lease, etc.) to the Lease. Any and a ll damage or loss sustained to (Crops, Livestock, Equipment, etc.) on the Land as a result of the operati ons of Operator under the Lease shall be paid to Tenant on the basis of the actual cash value of the damage or loss. All monies required to be paid in compliance with the surface use provisi ons in the Lease shall be paid to the surface owner, with the Tenant owning no right to those monies. This Consent and Subordination shall be binding on and inure to the benefit of Tenant and Operator and their respective heirs, personal representatives, successors, and/or assigns.
