MUSIC EVENT WAIVER AND AGREEMENT

This Music Event Waiver and Agreement (the Agreement) is made effective as of by and between the parties identified below.

Either party may terminate this Agreement for convenience upon written notice to the other party delivered at least days prior to the intended termination date. Termination for material breach shall be effective upon .

Assumption of Risk; Release; Indemnification

Participant acknowledges that attendance, performance, and participation at live music events involve inherent risks including, but not limited to, loud sound, crowd conditions, stage equipment, temporary structures, tripping hazards, and contact with other persons. Participant voluntarily assumes all such risks.

Release: To the fullest extent permitted by law, Participant hereby releases, waives, discharges and covenants not to sue Organizer and its affiliates, officers, agents, volunteers, employees, contractors, and promoters (Released Parties) for any and all liability, claims, demands, actions or causes of action arising out of or related to any loss, damage, or injury, including death, that may be sustained by Participant during or in connection with the Event, whether caused by the negligence of a Released Party or otherwise.

Indemnification: Participant agrees to defend, indemnify and hold harmless the Released Parties from and against all claims, liabilities, losses, damages, costs and expenses (including reasonable attorneys' fees) arising out of Participant's acts, omissions, breach of this Agreement, or violation of law in connection with the Event.

Medical Treatment

In the event of injury or medical emergency, Participant authorizes Organizer to obtain emergency medical treatment on Participant's behalf if Participant is unable to provide consent. Participant shall be responsible for all costs of such treatment.

Photo, Audio and Video Release

Participant grants to Organizer and its licensees the irrevocable right to photograph, record audio, and record video of Participant and to use, reproduce, distribute, and publish such materials for promotional, broadcast, archival, or other lawful purposes without further compensation to Participant, unless otherwise agreed in writing.

Confidentiality

Participant acknowledges that certain information disclosed by Organizer may be confidential. Participant shall not disclose confidential information to third parties and shall use such information solely to perform obligations under this Agreement. This obligation survives termination of this Agreement for a period of two years.

Governing Law; Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction specified below. Any dispute arising out of this Agreement shall be resolved by binding arbitration administered in that jurisdiction, except that either party may seek injunctive relief in a court of competent jurisdiction.

Entire Agreement; Severability

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous negotiations and agreements, whether written or oral. If any provision of this Agreement is held invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.

By signing below, Participant acknowledges that Participant has read this Agreement, fully understands its terms, and signs it voluntarily. Participant represents that Participant is at least 18 years of age, or that a parent or legal guardian has executed this Agreement on Participant's behalf where required.
