What the Nanny Services Agreement Is and When It Applies

A Nanny Services Agreement is a written contract between a family (or household employer) and a nanny that defines duties, schedule, compensation, benefits, confidentiality, and termination terms. It records expectations about childcare tasks, transportation, authorized caregivers, sick-day procedures, and permitted visitors. While often bilateral and private, the agreement can be used as evidence for payroll classification, background-check requirements, and employer tax obligations. This document helps reduce misunderstandings and provides a clear record should disputes arise or third parties (tax authorities, courts) request proof of terms.

Why a Written Nanny Services Agreement Benefits Both Parties

A clear, written agreement reduces disputes, documents compensation and tax responsibilities, and clarifies day-to-day expectations for childcare and household rules. It also supports correct payroll classification and hiring compliance.

Why a Written Nanny Services Agreement Benefits Both Parties

Who Typically Uses a Formal Nanny Services Agreement

Families hiring live-in or live-out nannies, household employers, and professional nanny agencies commonly use this agreement to document working relationships and obligations.

  • New employers hiring a nanny for regular hours, before payroll and tax setup are finalized.
  • Nanny agencies contracting with households to provide placement and ongoing coordination services.
  • Estate or family offices employing household staff for multiple residences or complex schedules.

Clear scope and signatures protect both the household and the caregiver by establishing expectations, tax posture, and termination mechanics.

Typical Signers and Their Roles

Household Employer

A parent or guardian who acts as the legal employer and signs to accept responsibility for wages, tax withholding, benefits, and compliance. The employer should be prepared to document payment method, payroll setup, and any reimbursable expenses.

Nanny / Caregiver

The individual providing childcare services who signs to accept duties, schedule, compensation, confidentiality, and termination terms. The nanny should verify identity, provide background-check consent, and keep copies of signed pages for records.

Step-by-step: Complete and Execute the Agreement

Follow these sequential steps to assemble, review, sign, and retain the Nanny Services Agreement for legal and payroll purposes.

  • 01
Draft Terms: Populate names, duties, schedule, pay, benefits, and termination clauses.
  • 02
Verify Background Checks: Confirm consent and results for background and reference checks.
  • 03
Agree on Payroll: Decide employment classification and withholding responsibilities.
  • 04
Sign and Store: Have both parties sign, date, and retain copies for records.

Typical Workflow for Signing and Distributing the Agreement

This outlines a common flow from initial draft to a fully executed document available to both parties and for payroll use.

  • Create Draft: Prepare the agreement with all required fields filled.
  • Review & Negotiate: Share with nanny, review changes, and confirm mutual acceptance.
  • Sign: Collect signatures from employer and nanny; consider witness or notary if desired.
  • Distribute Copies: Provide signed copies to both parties and to payroll or tax preparer as needed.

Digital Setup: Field Configuration for Online Completion

Configure an electronic workflow so each signer receives only the fields they must complete and the audit trail is preserved.

Field Configuration
Signature Block Require signature and date for each party; lock after signing
Background Consent Checkbox and date; must be checked before signature
Pay Rate Editable by employer only; numeric format enforced
Emergency Contacts Text field with phone validation

Technical Considerations for eSigning and File Types

Choose a platform that supports PDF and DOCX, preserves an audit trail, and allows secure signer authentication.

  • Supported Formats: PDF and DOCX accepted
  • Authentication: Email link, SMS code, or multi-factor
  • Audit Trail: IP, timestamp, and action log

Ensure the chosen solution can export a signed PDF with an embedded audit trail and offers secure storage consistent with your record-retention plan.

Essential Clauses to Include in a Professional Agreement

A robust Nanny Services Agreement addresses duties, payment, confidentiality, child safety, logistics, and dispute resolution to minimize ambiguity and exposure for both parties.

Scope of Work

Define specific childcare responsibilities, household tasks, transportation duties, limits on babysitting outside hours, and expectations for school pickup or extracurricular supervision in practical detail.

Compensation & Benefits

State hourly or salary rates, overtime terms, paid time off, sick leave, holiday pay, and reimbursement mechanisms for mileage or supplies to avoid payroll disputes.

Hours & Schedule

Specify regular working days, start and end times, on-call expectations, meal and break periods, and rules for schedule changes and additional hours.

Background Checks

Document consent for criminal background checks, motor vehicle record checks, reference checks, and any child-protection clearances required by employer policy.

Confidentiality & Privacy

Include nondisclosure terms for family information, photographs, school or medical details, and specify any HIPAA-related handling if the nanny will access protected health information.

Termination & Severance

Describe notice periods, grounds for immediate termination for cause, final pay calculations, and return of household property to reduce post-employment disputes.

Supporting Documents to Attach or Provide with the Agreement

Attach key supporting items to make the employment relationship clear and to assist payroll, tax, and safety compliance.

Background-Check Report

Attach consent form and summary findings; retain signed authorization.

Emergency Protocols

Provide medical authorization, emergency contacts, and allergy information.

Payroll Setup

Include W-4/W-9 guidance, direct deposit form, and payroll contact details.

Driving Authorization

Record permissions for vehicle use and insurance requirements if applicable.

Time-sensitive Requirements and Standard Deadlines

Certain administrative actions tied to hiring and taxation have specific timing that affects reporting and penalties.

Provide W-9 on Request:

W-9 is furnished to a payer when requested; no universal calendar deadline applies.

Form 1099-NEC Deadline:

If nanny is an independent contractor, issue 1099-NEC to recipient and IRS by Jan 31.

I-9 Retention:

Keep I-9s for 3 years after hire or 1 year after termination, whichever is later (8 CFR §274a.2).

Payroll Tax Deposits:

Federal and state deposit schedules vary by liability amount; check IRS and state guidance.

Background Checks Timing:

Run and obtain results before the first unsupervised childcare assignment.

Key Milestones from Offer to Ongoing Employment

Track these stages to ensure legal compliance, payroll setup, and household readiness before the nanny begins work.

01

Offer Acceptance

Formal agreement signed and effective date set.

02

Pre-Start Checks

Complete background checks and reference verification before start.

03

Payroll Enrollment

Set up payroll withholding and direct deposit prior to first pay period.

04

Periodic Review

Schedule regular performance and schedule reviews every 3–6 months.

Common Mistakes to Avoid When Preparing the Agreement

  • Failing to specify hours precisely leads to unpaid overtime disputes and misclassification risks with labor authorities.
  • Using vague compensation language like 'competitive pay' without numeric rates complicates payroll and tax reporting.
  • Neglecting background-check consent and documentation raises liability and insurance exposure for the household employer.
  • Omitting termination procedures or notice periods increases the risk of abrupt service interruptions and contested final pay.

Penalties and Legal Risks from Incorrect or Missing Terms

Tax Penalties: Failing to file correct information returns can trigger IRC §6721 penalties
I-9 Violations: Improper I-9 retention or completion can lead to fines
Misclassification: Classifying an employee as contractor risks back taxes
Workers' Comp: Omitting required coverage may yield state penalties
Privacy Breach: Unauthorized disclosure of medical or child data creates liability
Enforceability: Unsigned or improperly witnessed agreements may be disputed

Security and Compliance Considerations for Stored Agreements

Encryption: AES-256 at rest
Transport Security: TLS 1.2/1.3 in transit
HIPAA: BAA required if PHI is present
Audit Trail: Maintain IP and timestamp logs
Access Controls: Restrict to authorized household users
Retention Policy: Follow stated retention timeline
