NEWBORN CARE CONTRACT

Parties

This Newborn Care Contract ("Agreement") is entered into by and between Client Name: (Parent/Guardian) and Caregiver/Provider Name: .

Recitals

WHEREAS, Client is the parent or legal guardian of the newborn child(ren) named below and requires professional newborn care services; and

WHEREAS, Caregiver represents that Caregiver is qualified, experienced, and available to provide newborn care services in accordance with the terms of this Agreement; and

NOW, THEREFORE, in consideration of the mutual promises contained herein, the parties agree as follows.

Scope of Work

Caregiver shall provide newborn care services to the Child including but not limited to feeding assistance, safe sleep supervision, diapering, soothing, basic infant care education for parents, monitoring of health and behavior, maintaining a care log, coordinating with medical providers in emergencies, and reasonable light laundry and bottle washing directly related to the Child's care. Caregiver shall not perform medical procedures except as explicitly authorized in writing by Client and the Child's attending physician.

Payment Terms

Compensation for the Services shall be as follows.

Client shall reimburse Caregiver for pre-approved out-of-pocket expenses related to the Child's care upon submission of receipts. Unless otherwise agreed, payment shall be due upon receipt of invoice. Overdue payments shall accrue interest or late fee as specified above and Caregiver may suspend services after written notice if payment is not made within seven (7) days of invoicing.

Term and Termination

This Agreement commences on Start Date: and shall continue until End Date: unless earlier terminated as provided herein.

Either party may terminate this Agreement for any reason by providing written notice to the other party at least Notice Period (days): days in advance. Immediate termination is permitted for material breach, dishonesty, substantiated neglect, or conduct placing the Child at risk.

Confidentiality

Caregiver shall maintain in strict confidence all non-public information concerning the Child and the family, including medical information, schedules, routines, and any privileged communications ("Confidential Information"). Caregiver shall not disclose Confidential Information to any third party except as required to provide the Services, as required by law, or with Client's prior written consent. This obligation shall survive termination of this Agreement.

Licenses, Background, and Health

Caregiver represents that Caregiver's statements regarding qualifications, training, and background provided to Client are true and that Caregiver will maintain required immunizations and provide proof upon request. Client may request current background or health documentation; refusal or falsification constitutes material breach.

Liability and Indemnification

Caregiver shall exercise reasonable care in performing Services. Client acknowledges that Caregiver is not a medical professional and will not be held responsible for conditions outside Caregiver's control. Each party shall indemnify and hold the other harmless from claims arising from that party's negligent or willful acts or omissions in connection with this Agreement.

Emergency Medical Authorization

In the event of a medical emergency and Client cannot be reached, Caregiver is authorized to seek emergency medical treatment for the Child. Client agrees to reimburse any reasonable expenses incurred. Parent/Guardian emergency contact:

Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of: without regard to its conflict of law principles.

Entire Agreement

This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, representations, and warranties, whether written or oral. Any amendment must be in writing and signed by both parties.

Miscellaneous

If any provision of this Agreement is held invalid, unenforceable, or illegal, the remaining provisions shall continue in full force and effect. Notices required under this Agreement shall be in writing and delivered to the contact information provided above.
