What the No Lease Inquiry Form Is and when it's used

A No Lease Inquiry Form is a written declaration used to confirm whether a specific property has an existing lease affecting occupancy or possession. It typically identifies the property, parties, and a certified statement that no active lease exists for the referenced premises. Common recipients include title companies, lenders, property managers, landlords, and municipal offices that require a formal record during closings, underwriting, tenant screening, or property transfer. The form can be completed on paper or electronically and may be executed under U.S. e-signature law where permitted.

Why a clear No Lease Inquiry Form matters

A concise certified statement reduces title risk, speeds underwriting and closing checks, and creates a dated record that supports dispute resolution. Clear completion minimizes follow-up requests and helps third parties rely on the current leasing status when making transactional decisions.

Common mistakes to avoid when preparing the form

  • Using an informal property description rather than the full street address and parcel or unit number leads to misidentification in title searches.
  • Allowing handwritten initials without a dated signature can create ambiguity about when the certification was executed and by whom.
  • Failing to attach or reference supporting termination documents forces requesters to seek additional verification and delays closings.
  • Not confirming the signer's authority to speak for a company or trust results in a need for corporate resolutions or power-of-attorney proof.
