What the Non-Resident Information Form Is

The Non-Resident Information Form is a standardized document used to collect tax, contact, and residency details from individuals or entities that are non-resident for a given U.S. tax or reporting purpose. It captures taxpayer identification numbers, permanent and mailing addresses, country of residence, and withholding status used by payers to determine backup withholding, treaty eligibility, and correct IRS reporting. Organizations use the completed form to substantiate withholding decisions, support information returns, and maintain auditable records for compliance and potential tax audits.

Why Accurate Non-Resident Data Matters

Collecting complete Non-Resident Information reduces withholding errors, supports accurate IRS reporting, and documents claimant status for treaty benefits. Proper completion helps avoid backup withholding and creates an auditable record that supports payer compliance with Internal Revenue Code obligations.

Why Accurate Non-Resident Data Matters

Who Commonly Completes This Form

Use this form when collecting tax residency and withholding details from non-resident individuals, foreign entities, or contractors.

  • Real estate firms verifying foreign investor withholding and FIRPTA withholding obligations during property transactions.
  • Payroll and HR teams documenting non-resident employees or contractors for federal and state tax reporting.
  • Financial institutions and brokers collecting taxpayer identification for information returns and FATCA reporting.

Retain completed forms with payer records to support withholding calculations, information returns, and any audit inquiries.

Foreign Contractor

A non-resident individual or business providing services to a U.S. payer. Supplies taxpayer identification or foreign TIN and any treaty claim. Must confirm name and document accuracy to avoid incorrect withholding and ensure correct reporting on Form 1099 or other information returns.

Essential Components of a Professional Form

A professional Non-Resident Information Form includes clear fields, authentication options, legal instructions, and data capture to support compliance and accurate withholding determinations.

Identification

Full legal name as on passport or government ID; include any business legal entity name and DBA. Accurate identification prevents mismatches with IRS records and reduces backup withholding risk.

Taxpayer ID

Provide SSN, ITIN, or foreign TIN in the exact format. If unavailable, state reason and follow payer backup withholding procedures. Incorrect TIN triggers IRS notices and possible penalties.

Residency Claim

Specify country of residence and factual basis for non-resident status, including dates and visa class if applicable. Supporting documentation may be required to substantiate treaty claims.

Withholding Status

Declare treaty benefit claims, reduced or exempt withholding, or indicate backup withholding applicability. Attach treaty statement or W-8/W-9 equivalent when needed to support tax positions.

Signature Block

Signer must date, sign, and print name; if signing on behalf of an entity, include capacity and authority statement. Unsigned forms are invalid for tax reporting purposes.

Instructions

Provide concise guidance on completing each field, acceptable ID types, and where to send the completed form. Clear instructions reduce errors and processing delays.
