Contract with Driver to Drive an Automobile from one State to Another Agreement made on the ___ day of __________, 20___, between _________________ of ______________________________________ (street address, city, county, state, zip code), referred to herein as Owner, and ___________________ of __________________________ (street address, city, county, state, zip code) , referred to herein as Driver. Whereas, Owner owns the following described automobile: Make ___________________________________________ Model ___________________________________________ Year ___________________________________________ VIN ___________________________________________ Whereas, Owner needs to have someone drive said automobile (hereinafter called Automobile) from ________________ (city and state) to ________________ (city and state) on ___________ (date); and Whereas, Driver agrees to perform these services under the terms and conditions set forth in this contract; Now, therefore, for and in consideration of the matters described above, and of the mutual benefits and obligations set forth in this agreement, the parties agree as follows: I. Payment Owner shall pay Driver the sum of $_________for services rendered pursuant to this agreement, said sum being due and payable on _____________ (date). II. Delivery and Return Delivery of Automobile shall be made to Driver at ___________________________ (street address, city, county, state, zip code) on _____________ (date) at ____________ (time of day). Return of Automobile shall be made to Owner at ___________________________ (street address, city, county, state, zip code) on ________ (date) at ___________ (time of day). Driver shall keep and maintain the Automobile so that it shall not be injured, and assumes liability for damage or loss resulting from Driver’s negligence or intentional acts. III. Relationship of Parties The parties intend that an independent contractor relationship will be created by this contract. Owner is interested only in the results to be achieved, and the conduct and control of the work will lie solely with Driver. Driver is not to be considered an agent or employee of Owner for any purpose, and Driver is not entitled to any of the benefits that Owner may provide for her employees. III. Liability The work to be performed under this contract will be performed entirely at Driver’s risk, and Driver assumes all responsibility for the condition of Automobile while it is in use pursuant to this agreement. Driver agrees to indemnify Owner for any and all liability or loss to Owner arising in any way out of the performance of this contract. Driver hereby releases Owner from all liability to the Driver for any and all loss of property or physical injury that may occur pursuant to this contract. V. Arbitration Any dispute under this agreement shall be required to be resolved by binding arbitration of the parties hereto. If the parties cannot agree on an arbitrator, each party shall select one arbitrator and both arbitrators shall then select a third. The third arbitrator so selected shall arbitrate said dispute. The arbitration shall be governed by the rules of the American Arbitration Association then in force and effect.
