What the Occupational Health and Safety Agreement Is

An Occupational Health and Safety Agreement is a written contract between an employer and other parties (employees, contractors, or service providers) that defines responsibilities, protocols, and procedures related to workplace health and safety. Typical content includes hazard identification, incident reporting, training requirements, personal protective equipment (PPE) rules, medical surveillance, regulatory compliance references, and responsibilities for corrective actions. The agreement formalizes expectations, assigns accountability, and sets dispute-resolution and recordkeeping procedures so employers can demonstrate due diligence under federal and state occupational safety laws.

Why a Formal Agreement Matters for Compliance and Risk Control

A clear Occupational Health and Safety Agreement documents who is responsible for hazard controls, training, and incident response, supporting compliance with OSHA and related state statutes. It helps reduce workplace injuries, clarifies insurance and indemnity positions, and creates an auditable record of employer efforts to manage risks.

Why a Formal Agreement Matters for Compliance and Risk Control

Who Typically Prepares and Signs This Agreement

Organizations and individuals who manage or work on-site commonly use this agreement to set binding safety expectations.

  • Employers and safety managers who set policy and ensure regulatory compliance at the workplace
  • Contractors and subcontractors who must accept site-specific safety requirements before performing work
  • Occupational health providers and insurers who verify training, medical surveillance, and reporting obligations

The document is also used by third-party vendors, subcontractors, and site owners to align safety practices before work begins.

Who Signs and Why

Company Safety Officer

The safety officer or designated compliance manager signs on behalf of the employer to confirm the company will provide required training, PPE, and reporting systems. Their signature ties organizational procedures to the agreement and is often required for audits or insurance validation.

Authorized Contractor

A contractor or subcontractor representative signs to accept site rules, confirm employee training, and agree to incident notification timelines. This signature allocates operational responsibility and can affect indemnity and insurance coverage in the event of an incident.

Core Elements to Include in a Professional Agreement

A complete Occupational Health and Safety Agreement organizes obligations so parties understand processes and legal duties. Include sections that are precise, measurable, and enforceable rather than aspirational statements.

Scope

Define the work, locations, parties, and duration covered by the agreement to prevent ambiguity during inspections or incidents.

Safety Roles

Specify who performs safety oversight, incident investigation, and corrective actions, with named contacts and escalation paths.

Training Requirements

List mandatory training topics, frequency, and recordkeeping responsibilities for verification during audits.

PPE and Controls

Detail PPE obligations, engineering controls, and procedures for hazard mitigation, including monitoring responsibilities.

Incident Reporting

Set timelines and formats for notifying parties of injuries, near misses, and regulatory reporting obligations.

Recordkeeping

State which documents are retained, retention periods, and who stores and provides access to records.

Step-by-Step: Completing the Agreement

Follow these sequential steps to prepare, review, and execute a compliant Occupational Health and Safety Agreement.

  • 01
Prepare document: Populate parties, scope, and dates; attach exhibits.
  • 02
Assign responsibilities: Clearly name safety officers and reporting contacts.
  • 03
Review with counsel: Have legal or insurance teams review liabilities and indemnities.
  • 04
Execute and distribute: Collect signatures and circulate signed copies to stakeholders.

Typical Processing Flow for the Agreement

A predictable workflow helps ensure each step is completed and documented for compliance and audit purposes.

  • Draft: Create the agreement with project-specific details and exhibits.
  • Internal approval: Safety and legal teams confirm obligations and insurance terms.
  • Signatures: Parties sign, date, and return the executed document.
  • Record and distribute: Store copies and notify supervisors and contractors.

Configuring an Electronic Workflow

When using an eSignature platform, set up fields and routing so safety officers and contractors sign in the correct order.

Field Configuration
Signature Order Sequential signing to ensure employer signs before contractor countersigns
Required Fields Make party name, effective date, and signatory title mandatory
Attachments Attach training records and insurance certificates as exhibits
Notifications Email alerts to safety officer and project manager after signing

How to Share and Distribute the Agreement Electronically

Choose a distribution method that preserves an audit trail and ensures each signer can access attachments and exhibits.

  • Email delivery: Send a signed PDF by secure email with read-receipts enabled
  • Document management: Store executed copies in a central DMS like Box or Google Drive
  • Enterprise integrations: Platforms often integrate with Salesforce, NetSuite, and Microsoft 365
