Shipper shall be responsible for any loss, damage or additional costs resulting from incorrect or incomplete information supplied by Shipper.

Liability: Except as otherwise provided by applicable carriage or insurance contracts, no party shall be liable for indirect, punitive, special or consequential damages arising from the shipment. Where liability is established, remedies shall be limited to direct damages consistent with the relevant transport contract and applicable law.

Confidentiality: The parties agree that commercial terms, packing details and pricing included in this document are confidential proprietary information and shall not be disclosed to third parties except as required by law, customs authorities, or to the extent necessary for handling, transport or insurance of the shipment.

GOVERNING LAW & ENTIRE AGREEMENT

Governing Law: This Packing List shall be governed by and construed in accordance with the laws selected by the parties for the underlying commercial contract. Where no governing law is selected, the laws of the jurisdiction in which the Shipper has its principal place of business shall apply.

Entire Agreement: This document, together with any referenced transport documents and commercial invoices, constitutes the complete statement of the packing particulars for the referenced shipment and supersedes prior statements concerning the packing specifics. In the event of any inconsistency, the transport contract and customs documentation shall control for carriage and customs purposes.
