What a Parenting Coordination Agreement Is and When It Applies

A Parenting Coordination Agreement is a written arrangement between separated or divorced parents that appoints a neutral parenting coordinator to help implement and interpret parenting plans, resolve minor disputes, and streamline communication about the children's care. It sets scope, decision-making authority, meeting processes, fees, confidentiality, and how decisions are documented or brought back to the court when required.

Why a Clear Agreement Benefits Parents and Children

A formal Parenting Coordination Agreement reduces conflict by defining the coordinator's role, timelines for decisions, and methods for dispute resolution, which preserves consistency for children and helps courts avoid frequent hearings over routine parenting disputes.

Why a Clear Agreement Benefits Parents and Children

Who Typically Uses a Parenting Coordination Agreement

Use depends on local court rules and the parents' willingness to delegate limited decision authority; the agreement can be voluntary or entered into as part of a court order.

  • Family law practitioners and judges who prefer streamlined post-decree dispute handling.
  • Parents seeking a neutral third party to handle recurring scheduling, school, or healthcare decisions.
  • Mediators and licensed parenting coordinators engaged by the parties or court.

Stepwise Process to Complete the Parenting Coordination Agreement

Follow these practical steps in order to prepare, agree, and execute a Parenting Coordination Agreement that courts and coordinators can rely on.

  • 01
Prepare Draft: Gather parenting plan, court order, and desired coordinator terms.
  • 02
Negotiate Scope: Agree on decision topics, limits, and confidentiality terms.
  • 03
Review with Counsel: Each parent should review with an attorney where possible.
  • 04
Sign and Date: Execute signatures and provide signed copies to the coordinator and attorneys.

Essential Clauses to Include in a Professional Agreement

Ensure the agreement contains clear operational clauses to avoid later disputes about the coordinator's role and the process for decisions.

Appointment

Name the parenting coordinator, include credentials, effective date, and termination conditions to define appointment and scope of authority.

Scope

Detail specific issues the coordinator can address (scheduling, extracurriculars, medical appointments) and expressly exclude major legal decisions.

Decision-Making Process

Describe how decisions are made (recommendation vs binding decision), required consultations, and timelines for written rulings.

Fees and Payment

State hourly rates, invoicing schedule, responsibility split between parents, and consequences for late payment or nonpayment.

Confidentiality

Address confidentiality of communications, exceptions for safety or mandatory reporting, and use of social media or recordings.

Enforcement

Specify how decisions may be enforced, whether decisions will be filed with the court, and the process for judicial review.

Supporting Documents Often Attached to the Agreement

Attach relevant exhibits to make the agreement actionable and reduce ambiguity in coordinator decisions.

Parenting Plan

Attach the existing parenting plan or custody order so the coordinator's role is coherent with court-ordered terms.

Contact Lists

Include up-to-date emergency contacts, school and healthcare provider details, and attorney contact information.

Decision Log Template

Provide a template for documenting coordinator decisions, dates, and rationales for transparency and recordkeeping.

Billing Policy

A clear invoice format and payment terms reduce disputes about fees and collection procedures.

Essential Information Fields and Data to Collect

Participant Names: Full legal names
Child Details: Names and birthdates
Coordinator Info: License, contact, credentials
Decision Scope: Topics included/excluded
Fee Terms: Rates and payment split
Signatures: Signed by all parties

Common Legal Risks and Consequences of Poorly Drafted Agreements

Non-enforceability: Ambiguous authority may render coordinator decisions unenforceable
Court Rejection: Court may refuse to adopt or enforce unclear provisions
Fee Disputes: Unclear billing causes collection and contempt exposure
Privacy Breach: Inadequate confidentiality put children’s data at risk
Unauthorized Decisions: Coordinator exceeding scope triggers legal challenges
Delay in Care: Slow decision timelines harm children's routine needs

Frequent Preparation Mistakes to Avoid

  • Leaving scope vague so routine disputes escalate into court motions instead of quick coordinator rulings.
  • Failing to define timelines for decisions, which causes delays and increases conflict between parents.
  • Omitting fee allocation details and payment process, which leads to billing disputes and service interruptions.
  • Using inconsistent names or dates that make the document difficult to match to court records.

Practical Tips to Make the Agreement Clear and Enforceable

Follow these best practices when drafting and executing a Parenting Coordination Agreement to reduce future disputes and increase enforceability.

Be Specific About Scope
Define precisely which issues the coordinator may resolve and which require court intervention. Clear boundaries prevent contentious overreach and unnecessary litigation.
Set Clear Timelines
Include explicit deadlines for responses and decisions. Measured timelines reduce delay and create an objective basis for enforcement if deadlines are missed.
Record Decisions in Writing
Require written decisions with date, reasons, and limited appeal path. Written records support enforceability and provide evidentiary clarity to courts.
Address Confidentiality and Reporting
State confidentiality boundaries and mandatory reporting exceptions (e.g., safety concerns). This balances privacy with legal obligations and reporting duties.
