Definition and role of a Parks Use Agreement

A Parks Use Agreement is a written contract between a parks agency (city, county, or state) and an individual or organization that requests use of a public park or recreation facility for an event, activity, or regular program. It sets permitted dates and times, location, obligations such as insurance and indemnity, any fees or deposits, and rules for setup, cleanup, and public safety. Agencies typically require a signed agreement before issuing a permit, collecting payment, or authorizing exclusive use of park spaces.

Why a clear Parks Use Agreement matters

A written agreement clarifies responsibilities, limits liability, and documents approval conditions so both the permittee and the parks agency understand operational, financial, and safety expectations.

Typical users and when they complete this agreement

Knowing which party initiates the agreement helps determine required documents, insurance levels, and the appropriate signatory authority for execution.

  • Parks agencies and municipal staff who review, approve, and enforce permit conditions.
  • Nonprofit event organizers, sports leagues, and vendors needing space for gatherings or activities.
  • Private companies and contractors performing permitted work, film shoots, or sponsored events.

  • Requesting exclusive use without a clear site plan or failing to mark staging and egress routes creates safety concerns that trigger additional review.
