PARTICIPANT LIABILITY WAIVER

This Participant Liability Waiver (the "Waiver") is entered into by the undersigned participant and, if applicable, the undersigned parent or legal guardian, in favor of the Organization identified below. The participant acknowledges that participation in the activity described below involves inherent risks and agrees to the terms set forth herein.

RECITALS

WHEREAS, Organization Name: operates, sponsors, or otherwise facilitates the activity described below; and

WHEREAS, Participant Name: wishes to voluntarily participate in the activity and acknowledges the risks inherent in such participation.

WHEREAS, the parties desire to set forth the terms under which the participant assumes risk and releases claims arising from the activity.

SCOPE OF ACTIVITY

ASSUMPTION OF RISK

The participant acknowledges and expressly agrees that participation in the activity may involve risk of property damage, personal injury, illness, or death. The participant knowingly and voluntarily assumes all risks, whether known or unknown, foreseeable or unforeseeable, arising out of or related to the participant's participation, including without limitation risks caused in whole or in part by the negligence of the Organization, its employees, volunteers, agents, or contractors.

RELEASE, WAIVER AND COVENANT NOT TO SUE

In consideration of being permitted to participate in the activity, the participant, on behalf of the participant and the participant's heirs, assigns, personal representatives, and next of kin, hereby releases, waives, discharges, and covenants not to sue the Organization, its officers, directors, employees, volunteers, agents, and sponsors (collectively, the "Released Parties") from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to the participant's participation in the activity, whether arising from the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

INDEMNIFICATION

The participant agrees to defend, indemnify, and hold harmless the Released Parties from and against any and all claims, liabilities, losses, damages, costs, and expenses (including attorneys' fees and court costs) arising out of the participant's acts or omissions during the activity, including claims asserted by third parties.

MEDICAL AUTHORIZATION AND REPRESENTATIONS

The participant certifies that the participant is physically fit and capable of participating in the activity. The participant authorizes emergency medical treatment deemed necessary in the event of injury or illness and agrees to be responsible for all costs of such treatment. The participant represents that the participant has disclosed to Organization any medical conditions, allergies, or medications that could affect safe participation.

EMERGENCY CONTACT

MINORS AND PARENT / LEGAL GUARDIAN CONSENT

If the participant is under eighteen (18) years of age, a parent or legal guardian must execute this Waiver on the participant's behalf. By signing below, the parent or legal guardian acknowledges that they have read and understand this Waiver and consent to the minor's participation.

PHOTOGRAPHY AND MEDIA RELEASE

The participant grants the Organization the right to photograph, record, and otherwise capture images or likenesses of the participant during the activity and to use such media for promotional, educational, or other lawful purposes, unless the participant opts out below.

GOVERNING LAW; SEVERABILITY; ENTIRE AGREEMENT

This Waiver shall be governed by and construed in accordance with the laws of the state or jurisdiction in which the Organization is located, without regard to conflict of law principles. If any provision of this Waiver is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. This Waiver constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior understandings and agreements, whether written or oral.
