What the Participant Rights Agreement Form Is

The Participant Rights Agreement Form is a written record that documents the rights, responsibilities, and choices of an individual who participates in a program, study, service, or activity. It typically covers consent, data use, confidentiality, revocation procedures, and contact information for questions or complaints. The form creates an auditable record of the participant’s acceptance of terms and, when signed electronically, must meet ESIGN and UETA standards to be admissible as a valid electronic record in U.S. commerce and intrastate transactions.

Why a Clear Participant Rights Agreement Matters

A clear form protects both participants and organizations by documenting consent, limiting misunderstandings, and clarifying data-handling practices. It supports regulatory compliance, reduces legal exposure, and creates a consistent process for obtaining and recording participant decisions under ESIGN and applicable state law.

Why a Clear Participant Rights Agreement Matters

Who Typically Completes This Form

Organizations, program administrators, and research teams use this form to document participant consent and rights before participation begins.

  • Research teams documenting informed consent for study enrollees, including data use and withdrawal options.
  • Healthcare providers collecting authorization for treatment, data sharing, or participation in care programs.
  • Program administrators enrolling individuals into social services, training, or paid study participation.

Participants complete the form to record their informed consent, selections on data sharing, and any opt-out or revocation preferences.

Core Elements to Include in a Professional Form

A well-constructed Participant Rights Agreement Form contains concise but complete sections that ensure participant understanding and provide legal clarity.

Consent Language

Plain-language explanation of what the participant is consenting to, including procedures, risks, benefits, and how consent may be withdrawn, minimizing ambiguity for enforcement or audit.

Revocation Process

Step-by-step instructions for withdrawing consent, including required notice format, any effects of withdrawal, and the effective date when revocation takes effect.

Signature Block
