Either party may terminate this Agreement for material breach if the breaching party fails to cure the breach within the notice period specified above. Carrier / Provider reserves the right to refuse carriage for safety, security, or operational reasons; refunds in such cases shall be governed by the payment and refund provisions set forth above.

CONFIDENTIALITY

Each party shall keep confidential and shall not disclose the other's proprietary or personal information obtained in connection with this Agreement, except as required by law or to perform the obligations herein. ACKNOWLEDGMENT, RELEASE AND CONSENT

By signing below, Passenger acknowledges that travel involves inherent risks including but not limited to delay, personal injury, or exposure to communicable conditions. LIMITATION OF LIABILITY

Except for willful misconduct or gross negligence, Carrier / Provider's liability for any claim arising under or related to this Agreement is limited to direct damages up to the total amount paid by Passenger for the specific trip at issue. Under no circumstances shall Carrier / Provider be liable for incidental, consequential, or punitive damages.

GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction specified below without regard to conflict-of-law principles.
