What the Performance Dance Captain Agreement Covers

The Performance Dance Captain Agreement is a written contract that defines the roles, responsibilities, compensation, rehearsal and performance schedules, and conduct expectations for a dance captain engaged by a company, school, or production. It establishes reporting lines, rehearsal obligations, choreography stewardship, substitution procedures, and intellectual property ownership for choreography or staging. The agreement can specify payment terms, tax classification (employee or independent contractor), confidentiality, injury and safety obligations, and dispute resolution. Properly executed, it reduces misunderstandings and supports compliance with labor, tax, and venue requirements across productions.

Why a Written Captain Agreement Matters

Use a Performance Dance Captain Agreement to set clear expectations for artistic leadership, scheduling, and compensation while reducing disputes and liability. It helps producers and captains document authority over choreography, understudy procedures, and health and safety responsibilities in a legally enforceable format.

Why a Written Captain Agreement Matters

Who Typically Completes and Signs This Agreement

Typical users include production managers, choreographers, school arts administrators, and freelance dance captains responsible for continuity and cast coordination.

  • Production managers and producers who hire captains to preserve choreography and manage rehearsals during runs.
  • Choreographers needing a designated lead to maintain artistic intent and coach replacements throughout the engagement.
  • Schools and conservatories engaging student or staff captains for productions, training records, and liability management.

Use the agreement to formalize expectations before rehearsals start and document role changes during a production's lifecycle.

Step-by-Step: Complete and Execute the Agreement

  • 03
Collect Signatures: Obtain signatures from captain and authorized company representative.

Core Clauses to Include in the Agreement

A thorough Performance Dance Captain Agreement combines operational, legal, and safety provisions so all parties understand authority, duties, payment, intellectual property, and dispute resolution.

Duties

Define specific responsibilities including maintaining choreography fidelity, leading rehearsals, coaching swings, documenting blocking, supervising understudy rehearsals, and communicating schedule changes. Clarity prevents scope disputes and ensures consistent artistic standards.

Schedule

Specify rehearsal days, call times, blackout periods, performance dates, and availability expectations. Include provisions for additional rehearsals, emergency coverage, and change notifications to limit confusion and last-minute disputes.

Compensation

State payment amount, method, frequency, overtime or per-performance rates, expense reimbursements, benefits eligibility if any, and consequences for missed calls or cancellations. Tie payment schedule to invoicing procedures.

IP & Choreography

Address ownership and rights to choreography, notation, and revisions. Specify whether choreography created or rehearsed by the captain is work-for-hire or licensed, and include credit or royalty terms if applicable.

Health & Safety

Outline medical clearance, warm-up expectations, injury reporting, return-to-work protocols, and required safety briefings. Allocate responsibility for providing safe rehearsal space and emergency procedures.

Termination

Include notice periods, cause definitions, severance or final payment terms, and procedures for replacing the captain. Define post-termination confidentiality and non-disparagement obligations.

Payment Disputes: Late or missing payments cause claims.
Safety Exposure: Noncompliance increases injury liability.
Confidentiality Breach: Unauthorized sharing risks legal action.
Notarization Failure: Missing notarization can impede enforcement.

Common Preparation Mistakes to Avoid

  • Failing to specify whether the captain is an employee or contractor leads to payroll errors, tax withholding problems, and possible back taxes or penalties.
  • Vague rehearsal schedules without exact dates or notice periods cause missed calls, understudy confusion, and disputes over additional compensation.
  • Omitting injury reporting procedures and medical clearance requirements increases organizational liability when performers are injured on site.
  • Using inconsistent names, missing signatures, or incorrect dates can invalidate the agreement or delay payroll and accounting reconciliations.

Community Theater

A midsize community theater hired a dance captain to maintain choreography across a six-week run and multiple understudies.

  • Reduced on-site rehearsal conflicts and performance errors.
