WHEREAS, Participant named above desires to participate in the activity or event described below (the "Activity") to be provided by Organization; and

WHEREAS, Organization provides facilities, personnel, or services in connection with the Activity and requires a written permission and release from each participant in order to permit participation and to manage risks; and

WHEREAS, the parties intend by this document to set forth the Participant's permission, assumption of risk, waiver of liability, and release and related covenants for the Activity.

Scope of Activity

Payment Terms (If Applicable)

Participant agrees to pay to Organization the fee set forth below in consideration of participation and related services.

Term and Termination

This Permission and Release shall commence on and continue through unless earlier terminated in accordance with this paragraph. Either party may terminate this agreement for convenience upon days' written notice to the other party. Termination does not limit Organization's right to collect unpaid fees accrued prior to termination nor limits Participant's continuing obligations under the release and indemnity provisions.

Acknowledgment of Risk, Waiver and Release

Participant acknowledges that participation in the Activity involves inherent risks, hazards, and dangers which may result in personal injury, death, or property loss. Participant knowingly and voluntarily assumes all risks associated with participation, whether foreseen or unforeseen.

In consideration for being permitted to participate, Participant, on behalf of Participant, Participant's personal representatives, heirs, and assigns, hereby RELEASES, WAIVES, DISCHARGES AND COVENANTS NOT TO SUE Organization, its officers, directors, employees, agents, contractors and volunteers (collectively, the "Released Parties") for any and all liability, claims, demands, actions, or causes of action for loss, damage, injury or death arising out of Participant's participation in the Activity, whether caused by the negligence of the Released Parties or otherwise, to the fullest extent permitted by law.

Participant further agrees to indemnify, defend and hold harmless the Released Parties from and against any and all claims, liabilities, losses, costs and expenses (including reasonable attorneys' fees) arising out of Participant's negligent or intentional acts or omissions in connection with the Activity.

Photo / Video and Publicity Release

Participant grants Organization the right to photograph, record, and otherwise use Participant's likeness, name, voice and biographical information in connection with Organization's promotional materials, publications, and web or electronic media without further notice or compensation. Participant releases any claims arising from such use.

Confidentiality

Participant and Organization each agree to keep confidential any non-public information received from the other party in connection with the Activity that is designated in writing as confidential or that reasonably should be understood to be confidential given the nature of the information and the circumstances of disclosure. This confidentiality obligation shall not apply to information that is publicly known or that is required to be disclosed by law.

Representations

Participant represents and warrants that Participant is physically able to participate in the Activity, and that Participant has disclosed to Organization any physical or mental condition or medication that may affect participation or health during the Activity. Participant agrees to comply with all rules, safety procedures, and instructions of Organization.

Governing Law; Entire Agreement

This Permission and Release shall be governed by and construed in accordance with the laws of the state or jurisdiction where Organization is located, without regard to conflict of law principles. Any dispute arising under this agreement shall be resolved in the courts of that jurisdiction.

This document constitutes the entire agreement between the parties with respect to Participant's participation in the Activity and supersedes all prior written or oral agreements or understandings. No modification of this agreement shall be effective unless in writing and signed by both parties.

What the Permission and Release Waiver Form Is

A Permission and Release Waiver Form is a written record in which an individual or guardian grants permission for a specific activity and releases another party from liability or certain legal claims tied to that activity. Common uses include media/photo releases, event participation waivers, volunteer authorizations, and medical treatment consent for minor participants. The document identifies the parties, describes the permitted activity, lists conditions and limitations, specifies any consideration, and includes signature and date lines. Properly drafted waivers clarify consent, set expectations, and provide evidence of informed agreement.

Why this Form Matters for Risk and Consent

A clear Permission and Release Waiver Form documents informed consent, reduces ambiguity about responsibilities, and preserves evidence of voluntary agreement. It helps organizers manage risk, supports insurance and claims handling, and creates a written basis for enforcing release language when legal disputes arise.

Why this Form Matters for Risk and Consent

Who Commonly Uses Permission and Release Waiver Forms

Organizations and individuals use these forms to authorize activities, collect consent, and limit liability before events or services.

  • Event organizers and vendors who host activities with physical or reputational risk.
  • Schools and youth programs collecting parental permission for field trips and media release.
  • Healthcare clinics and research teams obtaining consent for treatments or recordings.

Use the appropriate signer and language based on the participant type (adult, minor) and industry-specific rules.

Who Can Sign and Why It Matters

Adult Participant

An adult with capacity may sign on their own behalf to grant permission and waive claims. The signature should match a government ID and include printed name and date to ensure attribution and enforceability.

Parent or Guardian

A parent or legal guardian must sign for minors. Include the minor's full name, DOB, and a parental relationship statement. Some jurisdictions limit waivers for minors; follow state rules and include guardian contact details.

Essential Sections to Include in a Professional Waiver

A complete Permission and Release Waiver Form combines identification, clear consent language, defined scope, signature attribution, and record details to ensure clarity and legal weight.

Parties

Identify the releasor (participant or guardian) and the releasee (organization or individual receiving rights or protection) by legal name and contact information.

Description

Describe the activity or use precisely, including dates, locations, and any limitations on the permission granted to avoid overbroad interpretations.

Release Language

Include explicit waiver terms stating which liabilities or claims the signer releases, plus any exceptions such as willful misconduct.

Consideration

Note any consideration provided (e.g., entry, fee waiver, or services). A waiver lacking consideration may be more vulnerable to challenge in some jurisdictions.

Signature and Date

Provide a clear signature block for the signer, printed name, date, and relationship (if signing for a minor) to establish attribution and intent.

Optional Notary

If higher authentication is needed, include a notary acknowledgment or RON block; this increases evidentiary weight for some uses.

Common Pitfalls to Avoid

  • Using vague release language that fails to identify the activity or the exact claims being waived, creating ambiguity during disputes.
  • Collecting signatures without confirming signer authority or age, especially for minors, which can render the waiver unenforceable.
  • Failing to provide an ESIGN consumer disclosure for electronic consent in consumer-facing contexts, undermining legal compliance.
  • Storing signed waivers insecurely or without an audit trail, making it difficult to prove execution or reproduce records when required.

Risks and Legal Consequences

Unenforceable Waiver: Risk of invalidation
Minor Signature Issue: Possible nonbinding effect
HIPAA Exposure: Privacy violation fines
Insurance Denial: Coverage disputes
Notary Defects: Authentication challenges
Recordkeeping Gaps: Evidentiary problems

Practical Tips for Accurate and Efficient Waiver Completion

Follow these best practices to reduce disputes and streamline processing when collecting permissions and releases.

Use Plain Language
Draft release terms in plain English, define technical terms, and avoid overbroad wording that a court might construe narrowly or void.
Confirm Signer Capacity
Verify signer identity and authority, especially for guardians. Keep a copy of ID when appropriate and allowed by privacy rules.
Capture an Audit Trail
Record timestamp, IP address, authentication method, and version history so the signing event can be reconstructed if challenged.
Keep a Master Template
Maintain an approved template for similar activities and involve counsel when significantly changing scope or consideration.
