PERMIT FOR HUNTING RIGHTS This agreement hereby made this day by and between **- **, **, Ms. **, (herein called "Club"), and ________________________________________ _________________________(herein called "Permitee"), WITNESSETH: 1. For the sum of $3,000.00 paid by Permitee to Club and subject to the terms, conditions and provisions hereinafter set out, Club does hereby grant unto Permitee exclusive hunting rights for all game except rabbit, on the following described lands situated in Simpson County, Mississippi, to-wit: 2. This lease shall be subject to existing rights of any third parties and any rights which may from time to time hereafter be granted by Club affecting the lands described herein, and is granted without warranty of any nature. 3. This lease shall remain in effect until **,19** at which time it shall terminate unless extended in the manner hereinafter provided. In the event Club determines that Permitees are in violation of the provisions of this agreement, Club shall have the right to terminate this lease at his option at any time prior to the termination date by furnishing to Permitees by certified mail at Permitee's address shown above notice of such termination to take effect not less than 30 days after such notice is mailed as stated above. In the event of such prior termination Club shall refund to Permitee for each day this lease is terminated prior to the date set out above 1/365 of the consideration paid for this lease. 4. The hunting rights only herein granted to Permitee are subject to the rights of Club under the agreement between Club and **, Inc. 5. Permitee agrees to hold Club harmless for any and all liability and claims for damages and penalties and suits by reason of any injury or injuries to any person or persons or damage to property of any kind or nature whatsoever, and from any cause or causes whatsoever occasioned by any occupancy and use by Permitee and Permitee's guests, invitees, agents, servants and assigns for the premises described hereto, or any adjacent premises, or any activity carried on by Permitee or Permitee's guests, invitees, agents, servants and assigns in connection therewith, and Permitee hereby covenants and agrees to indemnify and hold harmless Club from all liability, charges, expenses, penalties, fees, judgments and costs as a result of such occupancy and use therefor by Permitee under this agreement. It is agreed that Permitee and Permitee's guests and invitees, while on Club lands pursuant to the provisions of this lease shall be licensees only, who may come upon the premises described herein at their own risk only after being fully informed, by inspection or otherwise, of dangerous conditions or hazards which may exist thereon, and who fully assume all risks of injury or damage to their persons or properties. It is the intention of Permitee to hold Club harmless from any and all liabilities whatsoever arising from or out of any occupancy or use of the lands described hereto by the Permitee and/or any person suffered to be upon said lands by Permitee, and Permitee agrees to protect and indemnify Club from any and all liability for personal injury and property damage.6. The Permitee shall assume full responsibility for and be liable to Club for any damage done by Permitee to the lands described herein, roads or timber thereon, whether by vehicles, fire or other causes. 7. Permitee agrees to prevent the violation of any game laws or regulations by any person hunting on the lands described hereto and to strictly observe all federal and state game laws which are applicable to the lands described herein. 8. During any time prior to the termination of this lease, Permitee for the term hereof shall have the right, subject to the provisions of this lease, to give public notice that hunting on the lands described herein is prohibited. 9. None of said lands shall be enclosed by fences nor shall any fences, buildings or other improvements be placed anywhere on lands. Permitee shall not use tractors, trucks or other mechanical equipment which will damage said lands or the timber. 10. Any other violation or restriction by any person shall not constitute a trespass against Permitee, but shall be reported to Club's representative for any action deemed necessary by Club. 11. Permitee shall not use any type vehicle on any portion of the land when weather conditions are such that the use of such a vehicle would damage roads or trails on the land. 12. Permitee shall not allow dogs to remain in kennels on the property after the expiration of deer hunting season.
