What a Personal Accommodation Agreement Is and When It’s Used

A Personal Accommodation Agreement is a written contract that documents specific accommodations provided to an individual to address a disability, medical need, religious requirement, or other personal circumstance. It sets out the parties, the exact accommodation measures (physical changes, schedule adjustments, services, or supplies), the effective dates, responsibilities for implementation, and any cost or liability allocations. The agreement creates a clear record that both protects the requesting party and guides the provider on performance expectations and monitoring during the accommodation term.

Why a Written Accommodation Agreement Matters

A clear, signed agreement reduces misunderstandings, documents consent and responsibilities, and creates evidence of good-faith compliance with disability or housing obligations under federal and state law.

Why a Written Accommodation Agreement Matters

Who Typically Uses a Personal Accommodation Agreement

Several parties rely on a written Personal Accommodation Agreement to formalize requests and responses.

  • Employees and supervisors negotiating workplace adjustments after a disability or medical event.
  • Tenants and landlords arranging reasonable modifications or services under housing law.
  • Schools or campus housing offices documenting student accommodation plans.

Use the agreement whenever parties need a documented, enforceable record of the accommodation, duration, and who pays or maintains any changes.

Essential Elements to Include in the Agreement

A professional Personal Accommodation Agreement should be concise but complete, covering identity of parties, a precise accommodation description, timing, responsibilities, review procedures, and signatures.

Parties

Full legal names and contact details for the individual requesting the accommodation and the provider or responsible organization.

Accommodation

A specific, measurable description of the accommodation (what is provided, altered, or restricted) and any technical specifications.

Duration

Clear effective date, review dates, and expiry or renewal conditions to avoid ambiguity about time frames.

Responsibilities

Who installs, inspects, maintains, funds, or removes the accommodation, plus monitoring and reporting duties.

Cost and Liability

How costs are allocated, any indemnity provisions, and insurance or warranty expectations.

Modification / Termination

Process to amend, revoke, or terminate the accommodation, including notice requirements and dispute resolution.

Step-by-Step: How to Prepare and Execute the Agreement

Follow these steps to create a complete Personal Accommodation Agreement that all parties can rely on.

  • 01
Draft: Gather facts, draft specific accommodation language, and include dates.
  • 02
Review: Have relevant managers, facilities, or legal counsel review proposed terms.
  • 03
Sign: Obtain signatures from all parties and any witnesses or notary if required.
  • 04
Distribute: Provide signed copies to requestor, provider, HR, housing office, and maintain records.

Typical Routing and Filing Flow for the Agreement

A clear routing path helps ensure timely implementation and proper record retention for audits or disputes.

  • Initiation: Requester submits the accommodation request with supporting documentation.
  • Internal Review: Designated office evaluates feasibility and prepares the draft agreement.
  • Execution: Parties sign; notarize if state or institutional policy requires authentication.
  • Recordkeeping: Store the signed agreement in HR, facilities, or tenant file with access controls.

Configuring an Online Accommodation Workflow

Set up form fields, signer order, and retention settings to match your organization’s process and compliance needs.

Field Configuration
Notification Email and optional SMS alerts to parties and administrators
Signer Authentication Use email OTP or stronger methods for sensitive accommodations
Conditional Fields Show follow-up questions when the requester indicates medical or structural needs
Retention Policy Export signed PDF/A and store per document retention rules

Technical and Security Considerations for Digital Completion

Choose a platform that supports secure signing, audit trails, and required integrations for your environment.

  • Document Formats: PDF and DOCX support for signed outputs
  • Integrations: Connects with HR and document management systems
  • Security: TLS in transit and AES-256 at rest

Ensure the provider supports ESIGN/UETA compliance, offers audit trails for attribution, and, if needed, a BAA for HIPAA-covered healthcare workflows.

Typical Timeframes and Expectations

Time requirements for responding to accommodation requests vary; document agreed response times to manage expectations and legal risk.

Request Acknowledgement:

Confirm receipt promptly, typically within 1–3 business days.

Interactive Process:

Begin discussions without undue delay; many organizations aim to start within 5–10 business days.

Implementation Start:

Schedule installation or service start dates based on availability and safety constraints.

Interim Reviews:

Set review checkpoints (30, 60, or 90 days) to assess effectiveness.

Renewal or Expiry:

Specify notice period for nonrenewal or changes to the accommodation.

Common Mistakes to Avoid When Preparing the Agreement

  • Vague descriptions that fail to define measurable performance or dimensions of the accommodation.
  • Omitting responsibilities for installation, maintenance, or cost, which leads to downstream disputes.
  • Failing to document review dates or termination conditions, which creates ambiguity over duration.
  • Not obtaining signatures from all required parties or neglecting required authentication or notarization.

Risks and Potential Consequences of an Incomplete or Incorrect Agreement

Discrimination Claims: Regulatory complaints or lawsuits under ADA or FHA
Breach of Contract: Civil damages or specific performance claims
Privacy Violations: HIPAA penalties for mishandled health information
Financial Exposure: Unexpected cost obligations or indemnity claims
Operational Delay: Implementation hold-ups leading to service disruption
Recordkeeping Liability: Sanctions for failing to retain required records

Practical Examples of Personal Accommodation Agreements

Two representative scenarios show how agreement language and attachments differ by use case.

Workplace Adjustment

An employee requests an ergonomic workstation and schedule change to accommodate a medical restriction.

  • The employer specifies equipment model, delivery date, and trial review at 30 days.
  • The signed agreement assigns supplier responsibility for installation, a 30-day performance review, and written process for returning equipment if the accommodation ends.

Housing Modification

A tenant requests a ramp and grab bars for mobility needs.

  • The landlord agrees to install specified fixtures and retain a copy of contractor permits.
  • The agreement includes restoration obligations at move-out, responsible parties for maintenance, and a timeline for completion with inspection checkpoints.

Practical Tips for Drafting Reliable Accommodation Agreements

Use plain language, measurable terms, and a documented review process to reduce disputes and support compliance.

Use measurable descriptions
Specify exact dimensions, equipment models, hours of service, or schedules so the accommodation can be validated and tested.
Assign clear responsibilities
Identify who installs, funds, inspects, and maintains the accommodation to avoid later disagreements about upkeep or costs.
Include review checkpoints
Schedule interim reviews to confirm the accommodation is effective and to document any necessary adjustments in writing.
Keep consistent records
Store signed agreements, supporting medical or technical documents, and communications in a secured, auditable file.
