Use, Care & Restrictions

Renter agrees to operate the bicycle in a careful and lawful manner, to wear a helmet at all times while riding, and to comply with all applicable traffic and safety laws. Renter shall not: (a) permit any person not listed in this Agreement to ride the bicycle; (b) use the bicycle for racing, stunts, or off-trail activities not intended for the bicycle; (c) operate the bicycle under the influence of alcohol or drugs; or (d) sublet, lend, or transfer the bicycle to another person.

Renter acknowledges receipt of and satisfaction with the bicycle's working condition at pickup as noted in the pre-rental inspection checklist below.

Repairs, Damage, Theft & Loss

Renter is responsible for all damage to, loss of, or theft of the bicycle occurring during the rental term except for damage resulting solely from the Owner's gross negligence or willful misconduct. Renter shall notify Owner immediately of any accident, theft, or damage. Owner may deduct repair or replacement costs from the security deposit and may seek additional compensation for amounts exceeding the deposit.

Insurance & Liability Waiver

Renter represents that Renter has adequate personal accident and property insurance for the rental period or accepts responsibility for all medical, property, and other costs arising from Renter's use of the bicycle. To the maximum extent permitted by law, Renter releases and holds Owner harmless from any claims, liabilities, losses, damages, or costs (including reasonable attorneys' fees) arising from Renter's use of the bicycle, except to the extent caused by Owner's gross negligence or willful misconduct.

Indemnification

Renter shall indemnify, defend, and hold Owner harmless from any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to Renter's possession, use, maintenance, or operation of the bicycle during the rental term.

Default, Termination & Remedies

If Renter breaches this Agreement or fails to pay amounts due, Owner may terminate the rental, retake possession of the bicycle, retain the security deposit, and pursue all other remedies available at law or equity. Renter shall be liable for costs of collection, reasonable attorneys' fees, and any costs associated with recovery of the bicycle.

Miscellaneous

Governing law: This Agreement is governed by the laws of the state or jurisdiction where the bicycle is rented. Venue for disputes shall be the county or district where Owner resides. If any provision is found invalid or unenforceable, the remaining provisions remain in full force. This Agreement contains the entire understanding between the parties with respect to the subject matter and may be amended only by a written instrument signed by both parties.

Acknowledgment
