What a Personal Class Agreement Covers

A Personal Class Agreement is a written contract that sets the relationship between an instructor or provider and an individual participant for a private or small-group class. It typically defines parties, services, schedule, fees, cancellation and refund policies, health and safety expectations, liability and indemnity, data handling, and dispute resolution. When executed in electronic form, the agreement can meet federal e-signature rules under the ESIGN Act (15 U.S.C. ch. 96) and state-level rules such as UETA where adopted; certain exceptions may still require wet signatures or notarization depending on the jurisdiction and subject matter.

Why a Clear Agreement Matters for Classes

A concise Personal Class Agreement reduces misunderstandings, documents payment and cancellation terms, and clarifies liability and health requirements. It creates a reliable record for enforcement, tax reporting, and record retention while supporting online execution under ESIGN and state electronic signature laws.

Why a Clear Agreement Matters for Classes

Who Typically Uses a Personal Class Agreement

Common users range from independent instructors to training firms and educational programs that deliver one-off or recurring personal classes.

  • Independent instructors and freelancers delivering one-on-one or small-group lessons.
  • Gyms, studios, and community education departments offering private or semi-private sessions.
  • Event hosts and venues that need waivers, payment terms, and scheduling control.

The agreement is also used by venues hosting private instruction and by institutions that collect waivers, payments, and emergency contacts in advance.

Essential Parts of a Professional Agreement

A well-drafted Personal Class Agreement is modular so it can be reused, adapted, and executed electronically while protecting both parties and meeting basic legal requirements.

Parties

Clearly identify instructor and participant by full legal name and business name when applicable, including contact information and billing address to avoid identity disputes.

Services

Describe the class content, duration, number of sessions, delivery method, and any materials supplied or required so expectations are explicit.

Fees & Payments

State the total fee, payment schedule, accepted payment methods, late payment penalties, and any taxes or processing fees applied to registration.

Cancellation & Refunds

Specify notice periods, prorated refunds, transfer rules, and no-show policies to reduce later disputes and administrative burden.

Liability & Waiver

Include risk acknowledgement, assumption of risk language, and indemnity where permitted; ensure waiver language is clear but review state enforceability.

Health & Safety

Record any health representations, emergency contact info, COVID or vaccination policies, and agreed safety procedures for in-person sessions.

How to Complete and Sign the Agreement

Follow these sequential actions to prepare, deliver, and execute the Personal Class Agreement efficiently, whether on paper or using an e-signature platform.

  • 01
Prepare Document: Populate parties, schedule, fees, and policies before sending.
  • 02
Attach Supporting Items: Add waiver, health form, and liability insurance proof if required.
  • 03
Send for Signature: Use email, secure signing link, or in-person signing as appropriate.
  • 04

Typical Online Setup for Electronic Completion

When configuring an online signing workflow, map fields, authentication, and reminders to minimize signer friction and ensure compliance.

Where to Send or File a Completed Agreement

Decide routing rules before sending: who keeps the original and where copies are stored for tax, safety, or venue requirements.

  • Instructor Records: Keep signed original in secure business files for tax and dispute purposes.
  • Participant Copy: Provide a signed PDF to the participant as proof of terms and receipts.
  • Venue or Host: Send a copy to facility managers when venue rules apply.
  • Accounting: Forward payment and invoice details to bookkeeping or payroll.

Digital Signing and File Formats

Choose a platform that supports common file formats and secure signing to preserve enforceability and traceability.

  • File Types: PDF, DOCX, HTML supported
  • Authentication: Email, SMS code, or stronger
  • Integrations: CRM and cloud storage

Typically 48–72 hours before first session

Cancellation Notice:

Specify hours or days required for cancellation

Automatic Renewal Notice:

Common Mistakes to Avoid

  • Using vague cancellation language that leaves refund calculations unclear and invites disputes.
  • Collecting payments but failing to attach or store the signed agreement for tax and liability purposes.
  • Not specifying emergency and health information which can create liability gaps for in-person classes.
  • Attempting to waive unavoidable consumer rights or statutory protections without legal review.

Late Payment: Late fee applies
Invalid Waiver: Waiver may be unenforceable
Tax Reporting: Missing W-9 triggers backup withholding

Improper Consent: ESIGN requirements unmet
Venue Liability: Host may face claims
