What the Personal Doula Contract Is

The Personal Doula Contract is a written service agreement that defines roles, services, fees, scheduling, confidentiality, and emergency procedures between a doula and their client. It establishes expectations for prenatal visits, labor and birth support, postpartum care, and any on-call or standby arrangements. The contract typically addresses payment terms, cancellation and refund policies, limits of liability, client responsibilities, and consent for communication or sharing of medical information. When signed by both parties, the document creates enforceable obligations under contract law and may be executed electronically consistent with federal and state e-signature statutes.

Why a Written Doula Agreement Matters

A Personal Doula Contract clarifies services, payment, liability, and scheduling to reduce disputes and ensure shared expectations. It supports informed consent, documents scope of care, and provides a clear basis for resolving disagreements or seeking remedies under contract law.

Why a Written Doula Agreement Matters

Who Typically Completes and Signs This Contract

Typical users who complete or sign this contract include the doula, the birthing person, and their partner or designated contact.

  • Independent doulas and doula collectives delivering prenatal, birth, and postpartum support.
  • Clients hiring one-on-one support for home, birthing center, or hospital births.
  • Agencies contracting doulas for continuity of care or event-specific coverage.

Use the contract whenever services are scheduled or fees and responsibilities need documentation to prevent misunderstandings.

Core Elements Every Professional Contract Should Include

A professional Personal Doula Contract combines clear parties, a detailed scope of services, payment terms, risk allocation, confidentiality, and signature blocks to create enforceable expectations.

Parties

Identify the doula's legal name, business entity if applicable, and the client or birthing person's full legal name and contact information; accurate names support enforceability and tax reporting.

Scope of Services

List prenatal visits, labor attendance, postpartum visits, educational sessions, and any excluded services. Include expected response times and limits on on-call hours to avoid scope disputes.

Payment Terms

Detail total fee, deposit amount and timing, accepted payment methods, due dates, late fees, and the process for refunds or additional charges for extra services.

Cancellation Policy

Define notice periods, refunds for cancellations, rescheduling rules, and how force majeure or medical emergencies affect payment obligations.

Confidentiality & HIPAA

State whether doula will access PHI, include consent language, and attach a Business Associate Agreement when handling protected health information under HIPAA.

Signatures

Include signature blocks for all parties with printed names, dates, and optional witness or notary fields; specify that electronic signatures satisfy execution requirements.

Common Pitfalls to Avoid

  • Failing to specify scope and hours may cause disputes about when services begin, what counts as on-call time, and whether additional fees apply.
  • Using vague cancellation or refund language can create financial exposure and ambiguity that complicates refund processing and client relations.
  • Not addressing confidentiality and PHI handling risks HIPAA noncompliance if medical details are shared without proper consent or a Business Associate Agreement.
  • Relying on handwritten versions without retention of originals or audit trails makes enforcement and evidence collection harder in disputes or insurance claims.

Timing and Payment Milestones to Specify

Key timing considerations for the Personal Doula Contract, from booking to postpartum follow-up and payment milestones.

Booking deadline:

Reserve dates as early as possible; deposit secures scheduling.

Deposit due:

Typically due at signing; percentage varies by practitioner.

Practical Examples from Real Engagements

Real-world examples show how a Personal Doula Contract resolves expectations and protects both parties in practice.

Case Study 1

An independent doula used a detailed Personal Doula Contract for a home birth client to document scope, on-call hours, liability limits, and payment milestones before services began.

  • This prevented disputes about overtime fees.
  • When the client required a hospital transfer, the contract's emergency procedures, communication permissions, and payment terms clarified responsibilities, expedited coordination with medical staff, and allowed both parties to settle final billing without litigation.

Case Study 2

A birth center integrated standardized Personal Doula Contracts into intake workflows so doulas and clients signed consistent agreements addressing facility policies, credentialing, and shared liability coverage.

  • This reduced administrative disputes and billing confusion.
  • Standardized language simplified insurance requests, ensured doula insurance certificates were collected, and clarified transfer protocols, which reduced contractual ambiguity and shortened resolution time when scheduling conflicts or unexpected medical needs arose.

Practical Best Practices When Using the Contract

Practical tips to make the Personal Doula Contract clear, enforceable, and easy to manage for both practitioners and clients.

Use plain language and specific terms
Avoid vague phrases such as 'reasonable efforts' or 'as needed.' Specify exact hours, response times, and measurable deliverables. Clear language reduces disputes and helps courts interpret intent if enforcement is necessary; include examples where ambiguity could arise.
Define emergency transfer procedures and responsibilities
Spell out roles during hospital transfers, who handles transport logistics, notification procedures, and how fees are adjusted. Include consent for sharing medical information with emergency providers and ensure all parties acknowledge emergency protocols.
Record insurance, credentials, and liability coverage
Require doulas to provide proof of professional liability insurance and relevant certifications. Document policy limits and any indemnity clauses. Retain certificates of insurance as part of the client file to address third-party claims or contract disputes.
Use e-signatures and audit trails
Adopt a compliant e-signature workflow that captures timestamps, signer IP addresses, and a certificate of completion. Maintain a copy of the executed agreement and ensure the platform supports records reproduction under ESIGN and UETA standards.
