Cancellation, Rescheduling & Refunds

Cancellation by Host more than 30 days prior to the Event: full refund of amounts paid less any non-recoverable vendor costs. Cancellation within 30 days: deposit is non-refundable and Host remains responsible for any unrecoverable costs. Rescheduling requested by Host is subject to Provider availability; fees or additional charges may apply. Provider may cancel for safety, code compliance or staffing reasons and will return payments for services not rendered.

Liability, Insurance & Indemnification

Host and Provider each agree to indemnify and hold harmless the other party against claims, liabilities, and expenses arising out of their respective negligence or willful misconduct. Host is responsible for supervision of minors at all times. Provider is responsible for maintaining the premises in reasonably safe condition during the Event. Provider may require proof of insurance from Host or vendors; if required, Host shall furnish a certificate of insurance naming Provider as additional insured at least 7 days prior to the Event.

Alcohol, Conduct & Supervision

If alcohol is present, Host is responsible for compliance with applicable laws and for ensuring no minors are served. Provider may require licensed bartending services and proof of permits. Host shall ensure appropriate adult supervision for any activities posing a safety risk.

Damage, Security Deposit & Cleanup

Host is responsible for damage to Provider property caused by Host, guests, or vendors. Provider may require a security deposit to cover damage or extraordinary cleanup. Security deposit will be returned, less documented deductions, within a reasonable time after the Event.

Media Release & Privacy

Host grants Provider the right to photograph or record the Event for promotional or archival purposes unless Host provides written notice prohibiting such use prior to the Event. Provider will not disclose Host personal contact information to third parties except as necessary for event delivery.

Force Majeure

Neither party shall be liable for failure to perform due to causes beyond its reasonable control, including but not limited to acts of nature, government orders, labor disputes, or utility failures. Parties will use reasonable efforts to reschedule or agree on an equitable adjustment of fees.

Governing Law & Dispute Resolution

This Agreement constitutes the entire agreement between the parties with respect to the Event. Any dispute arising under this Agreement shall be resolved by negotiation between the parties and, if unresolved, by mediation. If mediation fails, the dispute will be resolved in the courts located in the state where the Event takes place.

Miscellaneous

No modification of this Agreement is effective unless in writing and signed by both parties. Headings are for convenience only and do not affect interpretation. If any provision is held unenforceable, the remaining provisions remain in full force.
