Copyright, License & Usage

Copyright: Photographer retains all copyrights to the images. Photographer grants Client a non-exclusive, non-transferable personal use license to the delivered images for personal, non-commercial use, including prints and personal online display.

Commercial Use: Any commercial, advertising, or resale use requires a separate written license and fee. Proposed commercial use must be disclosed in writing and approved by Photographer prior to use. Fee for expanded usage: $

Portfolio and Promotion: Client permits Photographer to use images for Photographer portfolio, self-promotion, competitions, and social media unless Client selects opt-out below.

Model Release & Privacy

Client hereby grants Photographer and Photographer's legal representatives and assigns the irrevocable right to use and publish photographs of Client for purposes of advertising, promotion, and trade, unless otherwise restricted in writing. Client agrees that Photographer may crop, retouch, or adjust images at Photographer's discretion.

Cancellation, Rescheduling & Force Majeure

Client cancellation: Retainer is non-refundable except where otherwise stated. If Client cancels within 14 days of the session date, Client is responsible for 50% of the remaining balance. Rescheduling within 7 days may be subject to additional fees.

Photographer cancellation: If Photographer cancels, Photographer will refund all fees and will make reasonable efforts to secure a replacement photographer. If a mutually acceptable replacement is not available, Client may receive a full refund or reschedule.

Force Majeure: Neither party shall be liable for failure to perform due to causes beyond reasonable control, including but not limited to acts of God, public health emergencies, strikes, civil unrest, or governmental orders. Affected party shall give prompt written notice and the parties shall attempt in good faith to reschedule.

Liability, Warranty & Indemnity

Limitation of Liability: Photographer's liability for any claim arising under this Agreement shall not exceed the amount of fees paid by Client under this Agreement. Photographer makes no warranty as to specific results or artistic outcomes.

Indemnity: Client agrees to indemnify and hold harmless Photographer against claims, damages, liabilities, and expenses arising from Client's breach of this Agreement or Client's negligence.

Turnaround, Editing & Archive

Standard turnaround for initial edited images: after the session. Rush delivery may be available for an additional fee: $

Archiving: Photographer will retain images for a period of from delivery. After that time, Photographer is not obligated to retain original files without separate storage agreement.
