What a Personal Romance Agreement Is

A Personal Romance Agreement is a privately drafted written contract used by consenting adults to record shared expectations, financial arrangements, confidentiality terms, and dispute-resolution procedures for a personal relationship. It can address living expenses, property use, privacy and digital content, communication boundaries, and separation procedures. This document is evidence of mutual intent and may be executed electronically or on paper to create a clear record of agreed obligations, preferences, and any agreed remedial steps if parties later disagree.

Why Documenting Agreements Can Help

Use a Personal Romance Agreement to set clear expectations, reduce misunderstandings, and provide contemporaneous written evidence of mutual decisions. When signed and retained under ESIGN and UETA frameworks, an electronically executed agreement can support enforcement and preserve proof of consent and attribution.

Why Documenting Agreements Can Help

Who Typically Uses This Agreement

Typical users include consenting adults, unmarried partners, and couples who want written clarity on financial and personal expectations.

  • Cohabiting couples formalizing household contributions, expense sharing, and asset use.
  • Parties documenting confidentiality, social media boundaries, and privacy expectations explicitly.
  • Individuals outlining dispute resolution, counseling steps, or agreed separation processes.

These agreements are flexible and private; parties may seek legal or notary services for added formality and evidentiary strength.

Core Components to Include

Core parts of a Professional Personal Romance Agreement cover identity, financial arrangements, boundaries, confidentiality, dispute resolution, and amendment procedures in clear, enforceable language.

Parties

Identify each party with full legal name, current address, and contact details; specify whether signing is individual or by legal representative and confirm capacity to contract.

Consideration

Boundaries

Set expectations about cohabitation, communication, social media conduct, shared responsibilities, personal property use, and privacy; include examples and escalation steps for breaches.

Confidentiality

State rules about private communications, photographs, and digital content; define permitted disclosures, duration of confidentiality, and remedies for unauthorized distribution.

Dispute Resolution

Specify mediation, arbitration, or court options, select governing law and venue, and describe procedures for notice, timing, and allocation of legal fees and costs.

Practical Drafting and Execution Tips

Follow clear drafting and execution practices to maximize clarity, evidence, and enforceability of a Personal Romance Agreement.

Use plain language and precise terms
Draft clauses in plain language, define ambiguous terms, and include numeric examples or thresholds where possible. Clear wording reduces interpretive disputes and helps mediators or courts determine party intent.
Document financial specifics and formulas
Specify exact dollar amounts, percentages, reimbursement formulas, payment schedules, and supporting account documentation to simplify future accounting and tax reporting and reduce disagreement about obligations.
Record consent and authentication methods
Capture evidence of intent with dated signatures, witness attestations, or electronic audit trails including timestamp and authentication method; store records to support later challenges.
Review periodically and amend formally
Schedule reviews or trigger-based reassessments; require written, signed amendments for substantive changes and record each amendment's effective date and consenting parties.
