What the Personal Roommate Removal Addendum Is

A Personal Roommate Removal Addendum is a written amendment to an existing lease that documents the voluntary removal of a named roommate from a residential tenancy. It records the effective date of removal, reallocation of financial obligations and security deposit portions, and whether the removed roommate remains liable under the base lease. The addendum can also specify keys, utilities, forwarding address, and any agreed release of liability. When signed by the landlord and impacted tenants, the addendum becomes part of the lease and clarifies responsibilities to prevent future disputes.

Why a Clear Addendum Matters

A signed removal addendum provides a clear, contemporaneous record of changed tenancy terms, reducing disputes about rent, deposit refunds, and liability. It protects landlords, remaining tenants, and the departing roommate by documenting consent, dates, and financial adjustments under the lease.

Why a Clear Addendum Matters

Who Typically Completes This Addendum

The addendum is used when one party to a multi-tenant lease departs and the remaining parties or landlord need to formalize the change.

  • Landlords and property managers formalizing tenancy changes and updating lease records.
  • Remaining tenants wanting written confirmation of rent and deposit reallocation.
  • Departing roommates seeking release from future lease obligations when agreed.

Use the addendum alongside the original lease and any move-out inspection reports to maintain an auditable record of the transaction.

Who Signs and What Their Role Is

Primary Tenant

Primary tenant or remaining co-tenants sign to confirm acceptance of amended rent and deposit splits. Their signature confirms they will assume any ongoing obligations allocated to remaining occupants and acknowledges any change in liability for the departing roommate.

Landlord / Manager

The landlord or authorized property manager signs to approve the removal and document the landlord's acceptance of the new tenant configuration. This signature records any agreed changes to lease repayment terms, security deposit handling, and access arrangements.

Essential Sections to Include in the Addendum

A professionally drafted addendum is concise but complete. Include the elements below to ensure enforceability and operational clarity.

Parties

List the full legal names of the landlord, remaining tenant(s), and departing roommate exactly as on the original lease and government ID, and state each party's role to avoid ambiguity.

Effective Date

Specify the exact MM/DD/YYYY effective date when the roommate is removed; this date governs proration, rent obligations, and the start of any release from liability.

Financial Allocation

Document how rent, utilities, and other recurring charges will be reallocated between remaining tenants; include proration calculations, payment due dates, and whether any deposit portion transfers.

Security Deposit Handling

State whether the departing roommate is refunded, assigned a portion of the deposit, or remains on record for any future liability; reference move-out condition report if applicable.

Release of Liability

If applicable, include a clear, signed release statement by the landlord that removes the departing roommate from future lease obligations to the extent agreed, or explicitly state continued liability.

Property Access and Keys

Address return of keys, removal from access control systems, forwarding address for final notices, and responsibility for property condition or repairs discovered after departure.

Step-by-Step: Completing and Recording the Addendum

Use this sequence to finalize the removal professionally and reduce follow-up questions.

  • 01
Draft: Prepare the addendum referencing the original lease terms and the agreed changes.
  • 02
Review: Have all parties review the terms, confirm amounts, and agree on the effective date.
  • 03
Sign: Execute signatures from landlord and all affected tenants; notarize if required by local practice.
  • 04
Distribute: Provide each signer with a copy and update the landlord’s tenant records.

How to Send and File the Signed Addendum

Choose a secure method to collect signatures and keep a clear filing trail for future reference.

  • In-Person Signing: Sign physically and retain the original in the landlord’s lease file.
  • Electronic Signing: Send via an eSignature platform with audit trail and consent records.
  • Notarization: Obtain notarization if state law or lease requires it, or to add evidentiary weight.
  • Record Update: Update tenant roster, payment records, and key/access logs after execution.

Configuring an Online Workflow for the Addendum

If you use an eSignature platform, configure these settings to minimize friction and ensure legal validity.

Document Template Create a reusable addendum template with fixed fields and conditional sections for deposit handling.
Signer Order Set signer order (e.g., departing roommate, remaining tenant, landlord) to capture sequential consent.
Authentication Require email verification and optional SMS code for signer identity validation.
Audit Trail Enable full audit logging to capture IP, timestamp, and action history.
Storage Save a signed, tamper-evident PDF in the tenant file and provide copies to all parties.

Digital Signing and Submission Considerations

Use platforms that support audit trails, secure storage, and the required authentication level for your jurisdiction.

  • File Formats: PDF and DOCX are standard and preserve formatting.
  • Integrations: Look for connectors to property management systems and cloud storage.
  • Authentication Options: Email, SMS, KBA, or advanced signer verification are common choices.

Platforms with audit trails and secure storage meet core ESIGN and UETA requirements; choose one consistent with your compliance needs and retention policy.

Timing considerations and common deadlines

Key timing items to track when executing a roommate removal addendum to avoid payment or compliance gaps.

Effective Date Clarification:

State the exact date rent proration begins.

Deposit Accounting Deadline:

State law dictates refund timing; varies by state.

Final Rent Payment:

Specify who pays final partial-month rent and when.

Key Return Timeline:

Document when keys are returned and access is revoked.

Record Retention:

Retain signed addendum with lease records for required period.

Common mistakes to avoid when preparing the addendum

  • Vague financial language: failing to specify exact dollar amounts or calculation methods leads to disputes and late-payment claims.
  • Missing signatures: leaving any affected party unsigned can render the document unenforceable or require re-execution.
  • Unclear release terms: not explicitly stating whether the departing roommate is released from future liability creates ambiguity.
  • Improper distribution: failing to provide all parties with final signed copies prevents consistent recordkeeping and can hinder enforcement.

Potential consequences of an incorrect or incomplete addendum

Lease Breach: Continued liability risk
Deposit Disputes: Refund conflicts
Tenant Liability: Unreleased obligations remain
Legal Fees: Potential litigation costs
Eviction Risk: Unresolved rent arrears
Record Gaps: Evidence problems later

How to update or revise an executed addendum

If terms change after execution, use a documented amendment workflow and obtain fresh signatures.

01

Identify Change:

Describe the precise clause or amount that needs revision.
02

Draft Amendment:

Create a concise amendment referencing the original addendum and lease.
03

Obtain Consent:

Get signatures from all original signers and the landlord.
04

Notarize If Needed:

Add notarization where state practice or evidentiary needs justify it.
05

Distribute Copies:

Provide each party a signed copy and update records.
06

Archive:

Store the revised paperwork with the original lease and prior addenda.

Real-world scenarios to illustrate typical resolutions

Two short scenarios show common outcomes and documentation choices when a roommate leaves.

Student Housing Example

A student moves out mid-semester after an agreed notice period

  • Remaining tenant covers prorated rent for the month
  • The landlord issues a signed addendum effective MM/DD/YYYY, allocates deposit portion, and updates the online tenant record to prevent future billing errors.

Urban Apartment Example

Two roommates agree one will depart and transfer utilities to the remaining tenant

  • Parties document exact utility split and closure dates
  • The departing roommate signs a release from future rent after landlord approval, returns keys, and receives a partial deposit refund as recorded in the move-out inspection.
