Cancellation and Refunds: Unless otherwise agreed in writing, deposits are non-refundable except as required by law. In the event of cancellation by either party, the canceling party shall be responsible for any unrecoverable costs as documented by receipts.

HEALTH, SAFETY, AND AUTHORIZATIONS

Traveler warrants that all information provided about medical conditions is accurate and authorizes the organizer to seek emergency medical treatment if the traveler is incapacitated. Traveler agrees to promptly provide medical documentation and insurance information when requested.

Traveler represents that they carry travel and medical insurance covering the dates of travel and will provide insurer name and policy number upon request.

ASSUMPTION OF RISK; RELEASE; INDEMNITY

Traveler acknowledges that travel involves inherent risks, including but not limited to illness, injury, loss, delay, or damage to person or property. Traveler freely accepts and expressly assumes all such risks. To the fullest extent permitted by law, Traveler releases, covenants not to sue, and forever discharges Organizer and its agents from any and all liability arising from Traveler's participation in the trip, except for willful misconduct or gross negligence.

Traveler agrees to indemnify, defend, and hold harmless Organizer against any claims, losses, liabilities, costs, or expenses (including reasonable attorneys' fees) arising out of Traveler's breach of this Agreement, negligent acts, or intentional misconduct.

CHANGES, CANCELLATION & FORCE MAJEURE

Plans may change. Organizer will use reasonable efforts to notify Traveler of changes, but shall not be liable for changes due to supplier actions, weather, acts of government, strikes, pandemics, terrorism, or other force majeure events. If the trip is cancelled for such reasons, Organizer will apply any recoverable funds to Traveler's account and will not be liable for incidental or consequential damages.

GOVERNING LAW; DISPUTE RESOLUTION

This Agreement shall be governed by the laws of the state specified below. The parties agree to attempt mediation in good faith prior to initiating litigation; if mediation fails, disputes shall be resolved in the courts of the chosen state or through binding arbitration if the parties both agree in writing.

REPRESENTATIONS; MISCELLANEOUS

Each party represents and warrants that they are authorized to enter this Agreement, that all information supplied is true and accurate, and that they will comply with applicable laws, entry requirements, passport and visa obligations. Failure to carry required travel documents or comply with laws is the traveling party's sole responsibility.

If any provision of this Agreement is held invalid, the remaining provisions will remain in full force and effect. This Agreement constitutes the entire agreement between the parties concerning the trip and supersedes all prior agreements and understandings.
