PET LIABILITY WAIVER AND SERVICE AGREEMENT

This Pet Liability Waiver and Service Agreement (the "Agreement") is made this by and between Service Provider Name: and Pet Owner Name: .

WHEREAS

WHEREAS, Provider operates a pet care facility or provides pet-related services and permits Owner to bring the pet(s) described below onto Provider premises or to receive services from Provider; and

WHEREAS, Owner desires to utilize Provider's services or access Provider's premises for the purpose set forth in the Scope of Work and agrees to assume the risks associated with care, handling, and presence of the pet and to release Provider from liability except as expressly set forth herein.

WHEREAS, the parties intend that this Agreement allocate responsibility for injury, loss, damage, and costs between the parties and provide indemnity and other protections to Provider as set forth below.

PARTIES AND PET INFORMATION

SCOPE OF WORK

Provider shall perform the services described below and Owner hereby authorizes Provider to perform such services for the pet identified above. Services may include but are not limited to boarding, daycare, grooming, supervised exercise, or other activities specifically agreed between the parties.

PAYMENT TERMS

Owner agrees to pay Provider the fees set forth below. Fees must be paid in accordance with the schedule. Failure to pay fees when due is a material breach of this Agreement and may result in termination of services and collection actions.

TERM AND TERMINATION

This Agreement commences on the Start Date below and continues until the End Date below or until earlier termination as provided. Either party may terminate this Agreement upon the required notice period; termination does not relieve Owner of liability for fees already incurred or for obligations arising prior to termination.

CONFIDENTIALITY

Each party shall keep confidential and not disclose to any third party any non-public business or personal information of the other party obtained in connection with this Agreement, except as required by law. Confidential information does not include information that is or becomes generally known to the public other than by a breach of this Agreement.

ASSUMPTION OF RISK; RELEASE AND INDEMNIFICATION

Owner acknowledges that animals are inherently unpredictable and that interaction with other animals, handling by staff, and presence on Provider premises involve risks of injury, illness, escape, or death. Owner voluntarily assumes all risks associated with the pet's participation in activities or receipt of services. To the fullest extent permitted by law, Owner hereby releases, waives, and discharges Provider, its owners, officers, employees, agents, and affiliates from any and all liability, claims, demands, actions, and causes of action arising out of or related to any loss, damage, injury, or death to person or property caused by the pet or occurring during the provision of services, except for gross negligence or willful misconduct.

Owner agrees to defend, indemnify, and hold harmless Provider from and against any and all claims, liabilities, damages, costs, and expenses (including reasonable attorneys' fees) arising from Owner's breach of this Agreement or from the acts or omissions of Owner's pet.

REPRESENTATIONS AND WARRANTIES

Owner represents and warrants that: (a) Owner is the sole legal owner of the pet or is authorized to execute this Agreement on behalf of the owner; (b) the pet is in good health and free of contagious disease; (c) the pet's vaccinations are current; (d) the pet has not harmed or shown aggressive or threatening behavior toward any person or other animal during the past twelve months unless disclosed below.

       

EMERGENCY AUTHORIZATION

In the event of illness or injury to the pet, Provider will attempt to contact Owner and Owner's emergency contact. If Owner cannot be reached and Provider reasonably determines that immediate veterinary care is required, Owner authorizes Provider to seek veterinary care and Owner agrees to be financially responsible for expenses incurred.

GOVERNING LAW; ENTIRE AGREEMENT

This Agreement shall be governed by and construed in accordance with the laws of the state in which Provider's primary place of business is located, without regard to conflict of law principles. The parties agree that jurisdiction and venue for any dispute arising under this Agreement shall be the state and federal courts located in that state.

This Agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior and contemporaneous agreements, understandings, negotiations, and discussions, whether oral or written. Any amendment to this Agreement must be in writing and signed by both parties.
