RELEASE (For Surface Damages for Pipeline Right of Way/Easement) State: County: Grantor: (Name and Address) Grantee: (Name and Address) Effective Date: Reference is made to that Right of Way (or Easement) or Agreement (the "Agreement ") dated ____, recorded in Volume ____, page ____, of the ____ Records of the county and state named above, between Grantor and Grantee, named above, covering and affecting the following lands (the "Lands") in that county: (Description of Lands Covered by Agreement) For adequate consideration, Grantor, named above, owner of the surface of the Lands that are the subject of the Agreement, acknowledges receipt of the full consideration for ente ring into the Agreement and receipt of payment for all damages to the surface of the Lands for the laying, maintaining, and operating a pipeline system as contemplated by and allowed in t he Agreement. Grantor acknowledges that the consideration received represents full and complete payme nt for and settlement of all damages to the surface of the Lands. In consideration for this c ompensation Grantor releases and discharges Grantee from any and all claims for losses and damages occasioned by or arising out of Grantee's operations on the Lands. In the event the Lands, or any part of the Lands, are subject to an existing surface l ease, whether or not such lease appears of record in the County where the Lands are located, Grant or agrees to compensate any surface lessee out of the monies paid to Grantor by Grantee a nd to indemnify and hold Grantee harmless from any claim, loss or liability pertaining to dama ges to crops and all other property which may be asserted against Grantee by the lessee in any such surface lease.
