What a Points Transfer Agreement Is and When It Applies

A Points Transfer Agreement is a written contract that records the transfer or assignment of loyalty, reward, or similar points between parties. It establishes the identities of the transferor and transferee, the number and type of points being moved, any consideration or fees, the effective date, and conditions or restrictions that affect the transferred balance. The agreement clarifies rights and liabilities for both parties, including reverse transfers, expirations, and dispute resolution. It can be used for individual transfers, corporate accounts, estate settlements, or business-to-business arrangements involving points as assets.

Why a Clear Points Transfer Agreement Matters

A well-drafted Points Transfer Agreement reduces disputes by documenting the exact asset being transferred, the required approvals, and any limitations on redemption. It protects parties by clarifying tax, privacy, and program-rule implications and by establishing remedies and governing law.

Why a Clear Points Transfer Agreement Matters

Who Typically Completes a Points Transfer Agreement

The specific signer and approval flow depends on program rules; confirm account authorization and required consents before completing the agreement.

  • Individual members transferring loyalty balances for personal use or to family members.
  • Corporate accounts reallocating points between subsidiaries or employee accounts.
  • Estate executors or trustees handling points assigned under a will or settlement.
