What a Pool Room Bar Agreement Covers

A Pool Room Bar Agreement is a written contract establishing the rights, obligations, and financial terms between the bar owner (or landlord) and the operator or party running the pool room and related services. Typical provisions define term length, revenue sharing for table fees and food or beverage sales, responsibility for equipment purchase and maintenance, hours of operation, insurance and indemnity obligations, compliance with liquor licensing and local ordinances, and termination rights. The agreement can be executed on paper or electronically; electronic signatures are legally recognized under the ESIGN Act (15 U.S.C. ch. 96) and UETA where adopted.

Why Parties Use a Formal Pool Room Bar Agreement

A clear written agreement reduces disputes, sets revenue and maintenance expectations, allocates regulatory risk (including liquor compliance), and documents insurance and indemnity obligations for enforcibility and recordkeeping.

Why Parties Use a Formal Pool Room Bar Agreement

Who Typically Prepares and Signs This Agreement

The Pool Room Bar Agreement is used by commercial venue owners and third-party operators to define operational and financial terms before beginning activities.

  • Bar owners and landlords arranging on-site game operations, covering venue control and licensing responsibilities.
  • Independent operators or promoters who run pool tables, tournaments, or gaming nights under a revenue-share model.
  • Vendors and equipment lessors supplying pool tables or pay-to-play systems and needing maintenance and liability terms.

Parties should ensure the signer has authority to bind the business and that local liquor and zoning requirements are addressed in the agreement.

Core Sections to Include in a Professional Agreement

A comprehensive Pool Room Bar Agreement organizes operational, financial, and legal terms so both parties understand responsibilities, risk allocation, and performance expectations.

Parties & Recitals

Identify legal entity names, doing-business-as (DBA) names, addresses, and the factual background that explains why the parties enter the agreement. Accuracy here matters for enforcement and tax reporting.

Term & Termination

Specify the contract start and end date, automatic renewal rules if any, early termination rights, notice periods, and remedies for breach to avoid ambiguity about when obligations start or stop.

Revenue Sharing

Define exactly how pool fees, tournament entry fees, tips, and any split of beverage or food sales are calculated, reported, and paid, including timing and audit rights.

Equipment & Maintenance

State which party supplies tables and equipment, who performs repairs, acceptable maintenance standards, and replacement responsibilities to prevent disputes over service levels.

Licensing & Compliance

Allocate responsibility for maintaining liquor licenses, permits, and compliance with local ordinances; require prompt notification of enforcement actions affecting operations.

Insurance & Indemnity

List required insurance types and limits (general liability, liquor liability), name additional insureds, and include indemnity language addressing third-party claims arising from pool room activities.
