The evaluation engagement commences on the Start Date and continues until the End Date or until earlier terminated in accordance with the notice provision below.

CONFIDENTIALITY & DATA USE

All non-public information provided by the Occupant to the Owner/Manager or Consultant in connection with this evaluation shall be treated as confidential and shall not be disclosed except to contractors engaged to carry out remedial actions or as required by law. Aggregated, anonymized findings may be used for internal reporting and to improve building operations; no personally identifiable information will be published without express written consent.

GOVERNING LAW; ENTIRE AGREEMENT

This document and any ancillary agreement between the parties concerning the evaluation are governed by the laws of the jurisdiction in which the building is located. This form, together with any completed payment terms and scope of work, constitutes the entire agreement between the parties regarding the subject matter herein and supersedes prior oral or written communications concerning the evaluation.
