What the Power of Attorney PCT Form Is

The Power of Attorney PCT Form is a legal document used in international patent practice to authorize an agent or representative to act on an applicant's behalf under the Patent Cooperation Treaty (PCT). Use precise names, dates, and identification to avoid delays in international filings.

Why a Proper PCT Power of Attorney Matters

The Power of Attorney PCT Form clarifies who may act for the applicant, ensures official communications are directed to an authorized agent, and streamlines international prosecution and correspondence. Common Preparation Errors to Avoid

  • Mismatched names or incomplete applicant identifiers delay processing and may prevent WIPO from linking the POA to the correct application.
  • Using informal or abbreviated company names can invalidate representation; always use the exact registered corporate name and relevant registration numbers.
  • Failing to specify scope of authority causes disputes; ambiguous language about powers for national-phase actions often requires corrective filings.
  • Skipping notarization or witness steps where required by the receiving office leads to rejection or requests for corrected documentation.

Consequences of an Incorrect or Incomplete POA

Processing Delay: May require corrective filings
Rejected Appointment: POA may be refused
Unauthorized Acts: Agent actions contested
Financial Penalties: Possible state notary fines
Tax Consequences: Record retention affects audits
Litigation Risk: Representation disputes possible

Timing Considerations and Typical Deadlines

Key timing relates to filing, national-phase deadlines, and when agent authority becomes effective for international prosecution.

File with PCT Application:

Provide POA at initial filing when possible

Effective Date:

Date determines agent's authority start

National-Phase Entry:

Confirm POA acceptance per state, often by 30 or 31 months

Notarization Timing:

Obtain notarization before submission if required

Record Updates:

Amend POA promptly upon changes in representation
