What the Prenuptial Agreement Questionnaire Is and When It’s Used

The Prenuptial Agreement Questionnaire is a structured intake form used to collect the factual and financial information needed to draft a prenuptial agreement. It gathers party identities, asset and liability schedules, income details, prior agreements, and any special terms the parties want included. Completed questionnaires help attorneys prepare enforceable provisions, identify potential legal issues early, and document full disclosure. When used alongside attorney review, notarization, and proper timing, the questionnaire supports clarity and reduces later disputes about what each party knew or agreed to.

Why a Detailed Questionnaire Matters for Prenuptial Agreements

A comprehensive questionnaire improves accuracy of financial disclosures, speeds drafting, and creates an evidentiary record that supports enforceability under U.S. contract and family-law standards.

Why a Detailed Questionnaire Matters for Prenuptial Agreements

Typical Users and Roles for the Prenuptial Agreement Questionnaire

The questionnaire is used by parties planning marriage, their attorneys, and family-law professionals to collect and verify material facts before drafting an agreement.

  • Engaged individuals and couples who need to document assets, debts, and expectations prior to signing a prenuptial agreement.
  • Family law or estate planning attorneys who use the responses to draft tailored, enforceable provisions and verify full disclosure.
  • Mediators or financial advisors who assist with valuation, disclosure reconciliation, and negotiation of settlement terms.

Clear roles and mutual understanding of who completes which sections reduce later disputes about disclosure and consent.

Step-by-Step: Completing a Prenuptial Agreement Questionnaire

Follow these core steps to prepare answers, confirm accuracy, and finalize the questionnaire for drafting.

  • 01
Gather IDs: Collect government IDs and full legal names for all parties.
  • 02
Compile Financials: Assemble bank, brokerage, retirement, and real estate statements.
  • 03
Answer Questions: Provide full, verifiable answers and attach supporting schedules.
  • 04
Review & Sign: Have counsel review, then sign with required notarization or witnesses.

Core Sections Included in a Professional Questionnaire

A standard Prenuptial Agreement Questionnaire organizes disclosures into distinct sections to ensure completeness and ease of conversion into a draft agreement.

Party Information

Identifying details, contact information, dates of birth, prior names, and marital history to confirm parties and jurisdictional ties.

Asset Inventory

Detailed schedules for real property, bank accounts, investments, business interests, and personal property including ownership and valuations.

Debt Inventory

Listing of mortgages, loans, credit cards, and contingent liabilities with balances and creditor details.

Support and Spousal Terms

Proposed waivers or limitations on spousal support, maintenance formulas, and conditions for modification or termination.

Disclosure Statements

Affirmations regarding completeness of disclosure, whether independent counsel was consulted, and any known omissions.

Execution Details

Signature blocks, date, notary or witness acknowledgements, and any state-specific execution instructions.

Essential Data Elements Collected in the Questionnaire

Party Names: Full legal names
Dates of Birth: MM/DD/YYYY
Assets: Descriptions & values
Liabilities: Creditor & balances
Income: Current annual figures
Attorney Info: Counsel names and contacts

Common Mistakes to Avoid When Preparing the Questionnaire

  • Incomplete asset schedules: failing to list bank accounts, foreign assets, or business interests can lead to claims of nondisclosure and potential invalidation.
  • Vague descriptions: using terms like 'miscellaneous property' without identifiers forces follow-up and weakens enforceability of specific allocations.
  • Signing too close to the wedding: last-minute execution can create allegations of duress; allow time for review and independent counsel.
  • Missing notarization or witnesses: skipping required acknowledgments in some states can complicate later enforcement or authentication.

Risks and Consequences of an Incorrect or Incomplete Questionnaire

Unenforceability: Court may refuse to enforce terms
Financial Adjustment: Post-judgment reallocations or support orders
Tax Implications: Unreported transfers may affect tax filings
Litigation Costs: Increased attorney and court expenses
Fraud Allegations: Claims if material facts concealed
Perjury Risk: False statements may have legal penalties

Where to Submit the Completed Questionnaire and Next Steps

After completion, the questionnaire is routed to the drafting attorney, preserved with supporting documents, and incorporated into the draft agreement for execution.

  • Send to Counsel: Email or secure portal upload to the drafting attorney
  • Attorney Review: Counsel drafts terms and flags follow-up items
  • Execute: Sign before notary or witnesses as required
  • Archive: Store executed copies with supporting schedules

Timing Considerations and Recommended Deadlines

Timing affects claims of coercion and the opportunity for independent counsel review; adopt clear internal deadlines for each stage.

Questionnaire Completion Target:

Complete at least 30 days before the wedding to reduce duress claims and allow counsel review.

Attorney Review Window:

Allow two weeks for counsel to draft and suggest revisions, or longer for complex estates.

Independent Counsel:

Parties should be advised to seek independent counsel; document whether counsel was retained.

Notarization Scheduling:

Schedule notarization or RON session after final draft approval and before execution.

Record Retention:

Store the executed agreement and questionnaire securely for the applicable retention period.

Practical Tips for Accurate and Efficient Questionnaire Completion

Follow these best practices to minimize revisions and preserve enforceability when the questionnaire becomes part of the prenuptial record.

Disclose Fully and Early
Provide complete asset and liability information at the outset. Full disclosure reduces the risk of later challenges and simplifies drafting.
Use Independent Counsel
Each party should consult their own attorney. Documenting independent advice strengthens the agreement against claims of coercion.
Keep Clear Supporting Documents
Attach account statements, deeds, and valuation reports. Source documents make reconciliation faster and reduce discovery needs.
Standardize Formats
Use MM/DD/YYYY dates, full legal names, and consistent monetary rounding to avoid ambiguity during drafting and enforcement.

Who Typically Signs or Authorizes the Questionnaire

Engaged Couple

Both prospective spouses sign and date the questionnaire after completing their respective schedules. Joint completion documents mutual disclosures and provides a contemporaneous record for the drafting attorney.

Family Law Attorney

An attorney or firm partner signs to acknowledge receipt and to confirm whether independent-counsel advisories were provided, which assists later enforceability analysis.

Practical Use Cases for the Prenuptial Agreement Questionnaire

Two representative scenarios illustrate how the questionnaire supports drafting and dispute avoidance.

Independent Counsel Documentation

A client completes the questionnaire and attaches bank and brokerage statements

  • The attorney reviews and drafts specific asset clauses
  • The resulting agreement withstands post-signature scrutiny because disclosures were documented and counsel involvement is recorded.

Cross-State Marriage Planning

Couple relocating between states completes questionnaire with domicile details

  • The drafting attorney includes governing-law provisions and execution steps
  • The team arranges notarization consistent with both states to reduce conflict of law complications later.
