What a Production Assistant Agreement Covers

A Production Assistant Agreement is a written contract that defines the working relationship between a producer or production company and a production assistant (PA). It sets scope of duties, compensation, scheduling, confidentiality, intellectual property assignment, expense reimbursement, termination rights, and any safety or travel requirements. The agreement clarifies whether the PA is an employee or independent contractor and documents insurance, tax, and compliance responsibilities. Well-drafted PA agreements reduce disputes, support payroll and tax reporting, and provide clear evidence of consent and obligations for both parties.

Why a Clear Agreement Matters for Productions

A concise written agreement prevents misunderstandings about duties, pay, intellectual property, and schedule. It protects the production by documenting consent, limiting liability, and ensuring compliance with tax and labor rules.

Why a Clear Agreement Matters for Productions

Who Typically Uses a Production Assistant Agreement

Production companies, independent producers, line producers, and freelance PAs use this agreement to set expectations and document compensation.

  • Independent Producers and Small Production Companies — Use the agreement for short-term shoots and freelance hiring to document scope and payment terms.
  • Studios and Production Offices — Standardize onboarding for multiple PAs across projects and ensure consistent IP and confidentiality terms.
  • Freelance Production Assistants — Use the agreement to confirm role, schedule, rate, expense reimbursement, and termination notice.

A single standardized agreement reduces onboarding time and helps with payroll classification, tax reporting, and record retention across projects.

Representative Signers and Their Roles

Producer / Employer

Producer or production company owner who hires the PA. Responsible for defining duties, approving expense reimbursement, ensuring payroll classification, and signing the agreement on behalf of the production entity.

Production Assistant

Individual hired to perform entry-level on-set or office duties. Signs to acknowledge scope, pay rates, confidentiality obligations, and any IP or release clauses that assign work-related rights to the employer.

Core Elements to Include in a Professional Agreement

A robust Production Assistant Agreement contains discrete sections that cover operational, financial, legal, and safety matters so both parties know rights and obligations during and after the engagement.

Scope of Work

Describe tasks, typical daily duties, reporting lines, and any required competencies or certifications. Be specific about on-set vs. office responsibilities to avoid scope creep and disputes.

Compensation and Expenses

Specify hourly or flat rate, overtime rules, pay frequency, and expense reimbursement process. Include per diem, mileage rate, and pre-approval requirements for reimbursable costs.

Scheduling and Term

State the engagement start date, expected hours, daily reporting time, and whether the position is at-will or for a fixed term; address call-time changes and rest-breaks.

Confidentiality and Non-Disclosure

Include clear confidentiality obligations covering scripts, proprietary processes, client lists, and pre-release material, with duration and permitted disclosures.

Intellectual Property and Releases

Assign rights to work product and grant necessary releases for photography, footage, and sound recordings created during the engagement, where applicable.

Termination and Liability

State grounds for immediate termination, notice periods for routine termination, indemnity limits, and insurance requirements such as workers' compensation and general liability.

Practical Use Cases from Production Workflows

Two typical scenarios illustrate how a Production Assistant Agreement is applied in real projects, from single-day shoots to season-long series support.

Independent Producer

A small independent producer hires a PA for a three-day shoot to handle logistics and set support.

  • The agreement defines hours, per diem, and equipment handling.
  • A brief written contract minimized scope disputes, ensured timely payment, and documented IP assignment for recorded behind-the-scenes footage.

Series Production Office

A production office on a multi-episode series brings on rotating PAs for several months.

  • The agreement covers scheduling, confidentiality, and overtime rules.
  • Standardized contracts and electronic signing accelerated onboarding, simplified payroll, and clarified ownership of any work product created during production.

Practical Tips for Accurate and Efficient Completion

Follow these best practices to reduce risk and speed onboarding when using Production Assistant Agreements across multiple projects.

Use Clear, Specific Language
Avoid vague terms. Define duties, reimbursable expenses, reporting structures, and acceptable substitutes for required certifications to prevent misunderstandings and disputes.
Verify Identity and Tax Forms Early
Collect I-9 documentation and a completed W-9 or W-4 before the first payroll run to avoid withholding issues and I-9 noncompliance penalties.
Choose Appropriate Signing Method
For remote hires, use an eSignature workflow with adequate authentication and an audit trail; consider notarization or RON only when jurisdictionally required.
Archive Signed Documents Securely
Store signed agreements and the audit certificate in a searchable, access-controlled repository for at least the retention period required by law.
