What a Production Gaffer Agreement Covers

A Production Gaffer Agreement is a written contract that sets the terms between a production company and the gaffer (the head electrician responsible for lighting on a film, television, or commercial set). It typically covers scope of work, production schedule, compensation and overtime, equipment and safety responsibilities, crew call times, insurance and indemnity provisions, intellectual property for lighting designs, termination, and applicable jurisdiction. The agreement can be executed as a paper document or electronically under U.S. e‑signature laws, and is commonly accompanied by crew lists, insurance certificates, and union or guild riders.

Why a Clear Gaffer Agreement Matters

Standardizing terms in a Production Gaffer Agreement reduces scope disputes, clarifies pay and hours, and documents safety and equipment responsibilities. Properly executed agreements support enforcement under ESIGN (15 U.S.C. §7001) or state UETA laws and simplify payroll and insurance administration.

Why a Clear Gaffer Agreement Matters

Who Typically Uses This Agreement

Production companies, line producers, and unit production managers use this agreement to hire a gaffer and document duties, schedules, and pay terms.

  • Independent gaffers working as contractors, especially on short shoots and per‑project basis.
  • Production companies hiring non‑union or day‑rate crew for lighting roles.
  • Line producers and production managers who need documented equipment, insurance, and safety obligations.

The agreement also benefits legal, payroll, and safety teams by centralizing contract terms and enabling consistent compliance across productions.

Core Sections to Include in the Agreement

Core sections of a professional Production Gaffer Agreement define responsibilities, compensation, schedule, equipment, insurance, and termination with clear performance metrics.

Scope of Work

Describe specific lighting duties, supervisory responsibilities, expected crew size, deliverables, location coverage, call times, and any technical standards or protocols the gaffer must meet during the production.

Compensation

Specify base rate, overtime calculation, per diem or travel allowances, payment schedule, payroll classification (employee vs contractor), and backup withholding/TIN requirements where applicable to avoid withholding penalties.

Schedule

Include start and end dates, estimated total hours, daily call/wrap times, mandatory rest periods, and procedures for schedule changes and emergency call‑ins with notice periods.

Equipment

Set responsibility for providing, transporting, insuring, and maintaining lighting gear; specify who supplies consumables and which items remain the property of the production, including rental agreements.

Insurance

Require liability and workers' compensation coverage limits, certificate of insurance requirements, naming of additional insured, and risk allocation through indemnity clauses and proof submission timelines.

Termination & Notice

Define termination for convenience or cause, notice periods, final compensation and equipment return procedures, and post‑termination obligations such as confidentiality, final accounting, and dispute resolution.

Safety Violations: OSHA citations for noncompliant lighting setups or unsafe practices.
Contract Disputes: Ambiguous scope risks payment disputes and delay claims.
Union Breach: Failure to follow union riders may incur penalties and picket risks.

Common Preparation Mistakes to Avoid

  • Omitting insurance certificate or listing incorrect policy limits, leading to work stoppage or withheld payments while coverage is verified.
  • Using informal or abbreviated names for parties or entities, which creates mismatches with payroll, vendor databases, and insurance certificates.
  • Failing to specify overtime calculation and meal/rest breaks, resulting in wage disputes or state labor law violations.

Practical Examples and Outcomes

Real examples showing how a Production Gaffer Agreement addresses common on‑set scenarios and contract outcomes.

Independent Contractor Hire

A freelance gaffer hired for a two‑week commercial shoot needed clear pay and equipment terms to avoid disputes.

  • Negotiated day rate and travel stipend.
  • Result: the signed agreement specified equipment responsibilities and required COI; payment processed on schedule, dispute avoided, and production insurance covered a lighting fixture damage claim, limiting liability and preserving the working relationship.

Union Production Compliance

On a union film production, the gaffer agreement incorporated a guild rider, overtime rules, and specific reporting to payroll.

  • Included union rider, overtime, and pension reporting.
  • Result: compliance with guild terms prevented retroactive fines, ensured correct pension contributions, and allowed expedited payments via pre‑verified COI and signed electronic records for smooth closeout.

Best Practices for Accurate and Efficient Completion

Practical practices to reduce errors, speed approval, and ensure compliance when preparing a Production Gaffer Agreement.

Collect COI before first day
Require a current certificate of insurance naming production as additional insured before the gaffer arrives on set; verify policy numbers and expiration dates, and store the COI with the signed agreement to support indemnity and claims processing.
Clarify pay and overtime terms
Define base rate, overtime multipliers, meal penalties, and the payroll method in clear numeric terms; include examples calculating overtime to reduce disputes and reference state labor law where applicable to ensure compliance.
Use conditional e‑form fields
Implement conditional fields for equipment, per diem, and travel so only relevant items appear to the signer; this reduces errors, speeds completion, and simplifies downstream payroll and accounting reconciliation.
Maintain signed records securely
Store signed agreements with audit trails, encrypted at rest, and maintain access controls; ensure retention aligns with IRS and HIPAA standards where applicable and follow state rules for litigation holds.

Typical Signatories and Their Roles

Production Manager

Production Manager or Line Producer: authorized to negotiate payment terms, accept insurance certificates on behalf of the production company, and sign contracts for crew within delegated authority; confirm corporate signing authority to avoid enforceability issues.

Gaffer

Gaffer — head electrician: responsible for lighting design execution and equipment oversight; signs to accept scope, equipment responsibilities, and safety obligations. If contracting as an entity, include authorized representative and tax identification details to ensure correct classification and payments.
