Confidentiality, Warranties & Liability

Confidentiality: The Service Provider shall treat all drawings, specifications, and project data as Confidential Information. Except as required for performance of the work or by law, neither party shall disclose Confidential Information to third parties without prior written consent. Confidential obligations survive termination of this document for three years.

Warranty: The Service Provider warrants that the drawing shall conform to the contract requirements and accepted industry standards for a period of one year from the date of acceptance. Corrections of nonconforming work shall be made at the Service Provider's expense where nonconformance is attributable to the Service Provider's design or preparation.

Limitation of Liability: Except for willful misconduct or gross negligence, neither party shall be liable for consequential or special damages. The aggregate liability for direct damages under this drawing shall not exceed the total fees paid for the drawing preparation.
