What the Project Management Fencing Agreement Covers

The Project Management Fencing Agreement is a written contract that sets the scope, timing, responsibilities, payment terms, access, and safety requirements for installation, repair, or removal of fencing on a specific property. It identifies the parties, describes materials and workmanship standards, allocates risk (insurance, indemnity, warranties), and sets inspection and acceptance criteria. The agreement can include milestones, permits, site access conditions, and lien waiver provisions. When properly executed, it governs contractor and owner obligations and provides the basis for dispute resolution and enforcement under governing state law.

Why a Clear Fencing Agreement Matters

Use a Project Management Fencing Agreement to reduce scope ambiguity, set payment and inspection expectations, protect against mechanic’s liens, and document permitting responsibilities. Clear written terms reduce disputes, speed approvals, and establish measurable milestones for contractor performance.

Who Typically Prepares and Signs This Agreement

Owners, general contractors, specialty fencing contractors, and project managers use the Project Management Fencing Agreement to document obligations, timelines, and payment terms.

Core Clauses to Include in the Agreement

Essential clauses in a Project Management Fencing Agreement clarify deliverables, risk allocation, payment mechanics, timelines, inspection criteria, and dispute resolution to reduce ambiguity and litigation risk.

Scope

Define materials, workmanship standards, exact linear footage, gate locations, and exclusions. Attach drawings or a schedule of values so acceptance criteria are measurable and scope creep is prevented.

Schedule

List start date, interim milestones, inspection windows, and completion date. Tie milestone payments to verified acceptance to align incentives and manage cash flow.

Payment

Specify the total contract price, deposit amount, progress payment schedule, retainage percentage, invoice submission requirements, and remedies for nonpayment such as interest charges, suspension, or termination rights.

Permits

Assign responsibility for securing permits, inspections, utility locates, and compliance with zoning or HOA rules; specify payment of permit fees, the permit holder, and timelines for scheduled inspections and approvals.

Insurance

Require contractor insurance limits, certificate of insurance naming owner as additional insured, and proof of workers’ compensation and general liability prior to site mobilization, with policy effective dates specified.

Dispute Resolution

Include governing law, venue, and chosen dispute process (mediation, arbitration, litigation) and specify how costs and attorney fees will be allocated if disputes arise, and timelines for initiating claims.

Security and Compliance Essentials

Encryption: TLS 1.2/1.3; AES-256 at rest
Audit Trail: Detailed timestamps, IPs, action logs
HIPAA (BAA): BAA available; supports protected health information
SOC 2: SOC 2 Type II certification available
21 CFR Part 11: Supports FDA-regulated record requirements
SSO & SAML: Single sign-on and enterprise authentication

Key Risks and Potential Penalties

Late Completion: Liquidated damages possible
Nonpayment: Contractor remedies limited
Incorrect Scope: Change orders disputed
Missing Permits: Fines and stop-work
Tax Reporting: Backup withholding 24%
Invalid Signature: Enforceability risk

Common Preparation Mistakes to Avoid

  • Vague scope statements lead to disagreement over materials, quantities, or excluded work and often require costly change orders and schedule delays.
  • Failure to tie payments to verification milestones can leave owners exposed to incomplete work and contractors to delayed cash flow or disputes.
  • Not assigning permit responsibility or failing to confirm inspections can produce regulatory fines and project stoppages.
  • Omitting lien waiver procedures and retainage terms increases risk of mechanic's liens and complicates final payment.

How Online Execution Typically Works

A standard online execution flow reduces friction: upload, field placement, signer routing, authentication, signing, and audit trail capture.

  • Upload: Upload finalized contract as PDF or DOCX.
  • Place Fields: Add signature, initials, date, and conditional fields.
  • Authenticate: Choose email, SMS code, or KBA.
  • Sign & Store: Signer reviews, signs, and receives completed copy.

Suggested Digital Workflow Settings

Configure an e-sign workflow to match your project sequence, approval needs, and retention policies before sending for signature.

Field Configuration
Signature Order Set signer roles and sequential signing order for accountability.
Authentication Choose email link, SMS one-time code, or knowledge-based answers.
Expiration Define link expiration and automatic voiding of unsigned documents.
Notifications Enable signer reminders, completion alerts, and audit exports.
Storage Store signed PDFs with timestamps and retention metadata.

Platform and Integration Considerations

Choose a platform that supports PDF, DOCX, templates, APIs, and integrations with common PM and storage tools.

  • File Formats: PDF, DOCX, and Excel supported
  • Integrations: Connectors for Procore and NetSuite
  • Authentication: SSO, SAML, and MFA options

Effective Date:

Agreement begins on the effective date in MM/DD/YYYY.

Start of Work:

Contractor must mobilize by the start date or within agreed notice period.

Milestone Deadlines:
